# §10157. Transportation

- (a)
  - (1) [^1] Transportation of [spent nuclear fuel](/usc/42/10101.md?p=23) under [section 10156(a) of this title](/usc/42/10156.md?p=a) shall be subject to licensing and regulation by the [Commission](/usc/42/10101.md?p=7) and by the [Secretary](/usc/42/10101.md?p=20) of Transportation as provided for transportation of commercial [spent nuclear fuel](/usc/42/10101.md?p=23) under existing law.
  - (2) The [Secretary](/usc/42/10101.md?p=20), in providing for the transportation of [spent nuclear fuel](/usc/42/10101.md?p=23) under this chapter, shall utilize by contract private industry to the fullest extent possible in each aspect of such transportation. The [Secretary](/usc/42/10101.md?p=20) shall use direct Federal services for such transportation only upon a determination of the [Secretary](/usc/42/10101.md?p=20) of Transportation, in consultation with the [Secretary](/usc/42/10101.md?p=20), that private industry is unable or unwilling to provide such transportation services at reasonable cost.
