# §10144. Consideration of effect of acquisition of water rights


The [Secretary](/usc/42/10101.md?p=20) shall give full consideration to whether the development, [construction](/usc/42/300s–3.md?p=7), and operation of a [repository](/usc/42/10101.md?p=18) may require any purchase or other acquisition of water rights that will have a significant adverse effect on the present or future development of the area in which such [repository](/usc/42/10101.md?p=18) is located. The [Secretary](/usc/42/10101.md?p=20) shall mitigate any such adverse effects to the maximum extent practicable.
