# §10005. Model statute


In order to encourage the administration of accreditation and certification programs by the [States](/usc/42/10003.md?p=7), the [Secretary](/usc/42/10003.md?p=6) shall prepare and transmit to the [States](/usc/42/10003.md?p=7) a model statute for [radiologic procedure](/usc/42/10003.md?p=2) safety. Such model statute shall provide that—

- (1) it shall be unlawful in a [State](/usc/42/10003.md?p=7) for individuals to perform [radiologic procedures](/usc/42/10003.md?p=2) unless such individuals are certified by the [State](/usc/42/10003.md?p=7) to perform such procedures; and
- (2) any educational requirements for certification of individuals to perform [radiologic procedures](/usc/42/10003.md?p=2) shall be limited to educational programs accredited by the [State](/usc/42/10003.md?p=7).
