# §4331. Regulations

- (a) The [Secretary](/usc/38/4101.md?p=8) (in consultation with the [Secretary of Defense](/usc/38/3002.md?p=5)) may prescribe regulations implementing the provisions of this chapter with regard to the application of this chapter to [States](/usc/38/4101.md?p=6), local governments, and private [employers](/usc/38/4303.md?p=4-A).
- (b)
  - (1) The Director of the Office of Personnel Management (in consultation with the [Secretary](/usc/38/4101.md?p=8) and the [Secretary of Defense](/usc/38/3002.md?p=5)) may prescribe regulations implementing the provisions of this chapter with regard to the application of this chapter to [Federal executive agencies](/usc/38/4303.md?p=5) (other than the agencies referred to in [paragraph (2)](#b-2)) as [employers](/usc/38/4303.md?p=4-A). Such regulations shall be consistent with the regulations pertaining to the [States](/usc/38/4101.md?p=6) as [employers](/usc/38/4303.md?p=4-A) and private [employers](/usc/38/4303.md?p=4-A), except that [employees](/usc/38/4303.md?p=3) of the [Federal Government](/usc/38/4303.md?p=6) may be given greater or additional rights.
  - (2) The following entities may prescribe regulations to carry out the activities of such entities under this chapter:
    - (A) The Merit Systems Protection Board.
    - (B) The Office of Special Counsel.
    - (C) The agencies referred to in [section 2302(a)(2)(C)(ii) of title 5](/usc/5/2302.md?p=a-2-C-ii).
