# §3225. Discharge or release under conditions which would bar the use of benefits


If a [participant](/usc/38/3202.md?p=3) in the program is discharged or released from [active duty](/usc/38/3002.md?p=6) under dishonorable conditions, such [participant](/usc/38/3202.md?p=3) is automatically disenrolled and any contributions made by such [participant](/usc/38/3202.md?p=3) shall be refunded to such [participant](/usc/38/3202.md?p=3) on the date of such [participant](/usc/38/3202.md?p=3)’s [discharge or release](/usc/38/101.md?p=18) from [active duty](/usc/38/3002.md?p=6) or within 60 days from receipt of [notice](/usc/38/4303.md?p=8) by the [Secretary](/usc/38/4101.md?p=8) of such [discharge or release](/usc/38/101.md?p=18), whichever is later.
