# §3111. Regulations to promote satisfactory conduct and cooperation


The [Secretary](/usc/38/4101.md?p=8) shall prescribe such rules and regulations as the [Secretary](/usc/38/4101.md?p=8) determines necessary to promote satisfactory conduct and cooperation on the part of [veterans](/usc/38/3701.md?p=b-2) who are pursuing [rehabilitation programs](/usc/38/3101.md?p=7) under this chapter. In any case in which the [Secretary](/usc/38/4101.md?p=8) determines that a [veteran](/usc/38/3701.md?p=b-2) has failed to maintain satisfactory conduct or cooperation, the [Secretary](/usc/38/4101.md?p=8) may, after determining that all reasonable counseling efforts have been made and are not reasonably likely to be effective, discontinue services and assistance unless the [Secretary](/usc/38/4101.md?p=8) determines that mitigating circumstances exist. In any case in which such services and assistance have been discontinued, the [Secretary](/usc/38/4101.md?p=8) may reinstitute such services and assistance only if the [Secretary](/usc/38/4101.md?p=8) determines that—

- (1) the cause of the unsatisfactory conduct or cooperation of such [veteran](/usc/38/3701.md?p=b-2) has been removed; and
- (2) the [rehabilitation program](/usc/38/3101.md?p=7) which such [veteran](/usc/38/3701.md?p=b-2) proposes to pursue (whether the same or revised) is suitable to such [veteran](/usc/38/3701.md?p=b-2)’s abilities, aptitudes, and interests.
