# §1507. Disappearance


Where a [veteran](/usc/38/1101.md?p=1) receiving [pension](/usc/38/101.md?p=15) under subchapter II of this chapter disappears, the [Secretary](/usc/38/101.md?p=1) may pay the [pension](/usc/38/101.md?p=15) otherwise payable to such [veteran](/usc/38/1101.md?p=1)’s [spouse](/usc/38/101.md?p=31) and children. In applying the provisions of this section, the [Secretary](/usc/38/101.md?p=1) may presume, without reports pursuant to [section 1506(a) of this title](/usc/38/1506.md), that the status of the [veteran](/usc/38/1101.md?p=1) at the time of disappearance, with respect to permanent and total [disability](/usc/38/1701.md?p=1), income, and net worth, continues unchanged. Payments made to a [spouse](/usc/38/101.md?p=31) or [child](/usc/38/1831.md?p=1) under this section shall not exceed the amount to which each would be entitled if the [veteran](/usc/38/1101.md?p=1) died of a [non-service-connected](/usc/38/101.md?p=17) [disability](/usc/38/1701.md?p=1).
