# §12271. Prevention, diagnosis, and treatment of tuberculosis in correctional institutions

- (a) **Guidelines—** The [Attorney General](/usc/34/10307.md?p=1), in consultation with the Secretary of Health and Human [Services](/usc/34/12291.md?p=a-51) and the Director of the National Institute of Corrections, shall develop and disseminate to appropriate entities, including [State](/usc/34/11103.md?p=7), [Indian](/usc/34/12291.md?p=a-18) tribal, and local correctional institutions and the Immigration and Naturalization Service, guidelines for the prevention, diagnosis, [treatment](/usc/34/11103.md?p=15), and followup care of tuberculosis among inmates of correctional institutions and persons held in holding facilities operated by or under contract with the Immigration and Naturalization Service.
- (b) **Compliance—** The [Attorney General](/usc/34/10307.md?p=1) shall ensure that prisons in the Federal prison system and holding facilities operated by or under contract with the Immigration and Naturalization Service comply with the guidelines described in [subsection (a)](#a).
- (c) **Grants—**
  - (1) **In general—** The [Attorney General](/usc/34/10307.md?p=1) shall make grants to [State](/usc/34/11103.md?p=7), [Indian](/usc/34/12291.md?p=a-18) tribal, and local correction authorities and public health authorities to assist in establishing and operating programs for the prevention, diagnosis, [treatment](/usc/34/11103.md?p=15), and followup care of tuberculosis among inmates of correctional institutions.
  - (2) **Federal share—** The Federal share of funding of a program funded with a grant under [paragraph (1)](#c-1) shall not exceed 50 percent.
  - (3) **Authorization of appropriations—** There are authorized to be appropriated to carry out this section—
    - (A) $700,000 for fiscal year 1996;
    - (B) $1,000,000 for fiscal year 1997;
    - (C) $1,000,000 for fiscal year 1998;
    - (D) $1,100,000 for fiscal year 1999; and
    - (E) $1,200,000 for fiscal year 2000.
- (d) **Definitions—** In this section—

  “[Indian tribe](/usc/34/11103.md?p=18)” means a tribe, band, pueblo, nation, or other organized group or community of [Indians](/usc/34/12291.md?p=a-18), including an [Alaska Native village](/usc/34/12291.md?p=a-2) (as defined in or established under the Alaska Native Claims Settlement Act ([43 U.S.C. 1601](/usc/43/1601.md) et seq.),[^1] that is recognized as eligible for the special programs and [services](/usc/34/12291.md?p=a-51) provided by the United States to [Indians](/usc/34/12291.md?p=a-18) because of their status as [Indians](/usc/34/12291.md?p=a-18).

  “[State](/usc/34/11103.md?p=7)” means a [State](/usc/34/11103.md?p=7), the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, American Samoa, Guam, and the United States Virgin Islands.
