# §935. Substitution of carrier for employer


In any case where the [employer](/usc/33/902.md?p=4) is not a self-insurer, in order that the liability for [compensation](/usc/33/902.md?p=12) imposed by this chapter may be most effectively discharged by the [employer](/usc/33/902.md?p=4), and in order that the administration of this chapter in respect of such liability may be facilitated, the [Secretary](/usc/33/902.md?p=6) shall by regulation provide for the discharge, by the [carrier](/usc/33/902.md?p=5) for such [employer](/usc/33/902.md?p=4), of such obligations and duties of the [employer](/usc/33/902.md?p=4) in respect to such liability, imposed by this chapter upon the [employer](/usc/33/902.md?p=4), as it considers proper in order to effectuate the provisions of this chapter. For such purposes (1) notice to or knowledge of an [employer](/usc/33/902.md?p=4) of the occurrence of the [injury](/usc/33/902.md?p=2) shall be notice to or knowledge of the [carrier](/usc/33/902.md?p=5), (2) jurisdiction of the [employer](/usc/33/902.md?p=4) by a [deputy commissioner](/usc/33/902.md?p=7), the [Board](/usc/33/902.md?p=20), or the [Secretary](/usc/33/902.md?p=6), or any court under this chapter shall be jurisdiction of the [carrier](/usc/33/902.md?p=5), and (3) any requirement by a [deputy commissioner](/usc/33/902.md?p=7), the [Board](/usc/33/902.md?p=20), or the [Secretary](/usc/33/902.md?p=6), or any court under any [compensation](/usc/33/902.md?p=12) order, finding, or decision shall be binding upon the [carrier](/usc/33/902.md?p=5) in the same manner and to the same extent as upon the [employer](/usc/33/902.md?p=4).
