# §3153. Eligible providers of youth workforce investment activities

- (a) **In general—** From the funds allocated under [section 3163(b) of this title](/usc/29/3163.md?p=b) to a [local area](/usc/29/3102.md?p=32), the [local board](/usc/29/3102.md?p=33) for such area shall award grants or contracts on a competitive basis to providers of [youth workforce investment activities](/usc/29/3102.md?p=71) identified based on the criteria in the [State plan](/usc/29/3102.md?p=58) (including such quality criteria as the [Governor](/usc/29/3102.md?p=22) shall establish for a training program that leads to a [recognized postsecondary credential](/usc/29/3102.md?p=52)), and taking into consideration the ability of the providers to meet performance accountability measures based on primary indicators of performance for the youth program as described in [section 3141(b)(2)(A)(ii) of this title](/usc/29/3141.md?p=b-2-A-ii), as described in [section 3112(b)(2)(D)(i)(V) of this title](/usc/29/3112.md?p=b-2-D-i-V), and shall conduct oversight with respect to such providers.
- (b) **Exceptions—** A [local board](/usc/29/3102.md?p=33) may award grants or contracts on a sole-source basis if such board determines there is an insufficient number of eligible providers of [youth workforce investment activities](/usc/29/3102.md?p=71) in the [local area](/usc/29/3102.md?p=32) involved (such as a rural area) for grants and contracts to be awarded on a competitive basis under [subsection (a)](#a).
