# §3131. Funding of State and local boards

- (a) **State boards—** In funding a [State board](/usc/29/3102.md?p=57) under this part, a [State](/usc/29/3102.md?p=56)—
  - (1) shall use funds available as described in section [3164(b)(3)](/usc/29/3164.md?p=b-3) or [3174(a)(3)(B)](/usc/29/3174.md?p=a-3-B) of this title; and
  - (2) may use non-Federal funds available to the [State](/usc/29/3102.md?p=56) that the [State](/usc/29/3102.md?p=56) determines are appropriate and available for that use.
- (b) **Local boards—** In funding a [local board](/usc/29/3102.md?p=33) under this part, the [chief elected official](/usc/29/3102.md?p=9) and [local board](/usc/29/3102.md?p=33) for the [local area](/usc/29/3102.md?p=32)—
  - (1) shall use funds available as described in [section 3163(b)(4) of this title](/usc/29/3163.md?p=b-4); and
  - (2) may use non-Federal funds available to the [local area](/usc/29/3102.md?p=32) that the [chief elected official](/usc/29/3102.md?p=9) and [local board](/usc/29/3102.md?p=33) determine are appropriate and available for that use.
