# §4303. Office of Native American Business Development

- (a) **In general—**
  - (1) **Establishment—** There is established within the [Office](/usc/25/4001.md?p=4) of the [Secretary](/usc/25/4302.md?p=9) an [office](/usc/25/4001.md?p=4) known as the [Office](/usc/25/4001.md?p=4) of [Native American](/usc/25/5802.md?p=5) Business Development.
  - (2) **Director—** The [Office](/usc/25/4001.md?p=4) shall be headed by a [Director](/usc/25/4302.md?p=1), appointed by the [Secretary](/usc/25/4302.md?p=9), whose title shall be the [Director](/usc/25/4302.md?p=1) of [Native American](/usc/25/5802.md?p=5) Business Development. The [Director](/usc/25/4302.md?p=1) shall be compensated at a rate not to exceed level V of the Executive Schedule under [section 5316 of title 5](/usc/5/5316.md).
- (b) **Duties of the Secretary—**
  - (1) **In general—** The [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall ensure the coordination of Federal [programs](/usc/25/3402.md?p=4) that provide assistance, including financial and technical assistance, to [eligible entities](/usc/25/4302.md?p=2) for increased business, the expansion of trade by [eligible entities](/usc/25/4302.md?p=2), and economic development on [Indian lands](/usc/25/4302.md?p=5-A).
  - (2) **Interagency coordination—** The [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall coordinate Federal [programs](/usc/25/3402.md?p=4) relating to [Indian](/usc/25/1934.md) economic development, including any such [program](/usc/25/3402.md?p=4) of the Department of the Interior, the Small Business Administration, the Department of Labor, or any other Federal agency charged with [Indian](/usc/25/1934.md) economic development responsibilities.
  - (3) **Activities—** In carrying out the duties described in [paragraph (1)](#b-1), the [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall ensure the coordination of, or, as appropriate, carry out—
    - (A) Federal [programs](/usc/25/3402.md?p=4) designed to provide legal, accounting, or financial assistance to [eligible entities](/usc/25/4302.md?p=2);
    - (B) market surveys;
    - (C) the development of promotional materials;
    - (D) the financing of business development seminars;
    - (E) the facilitation of marketing;
    - (F) the participation of appropriate Federal agencies or [eligible entities](/usc/25/4302.md?p=2) in trade fairs;
    - (G) any activity that is not described in [subparagraphs (A) through (F)](#b-3-A..b-3-F) that is related to the development of appropriate markets; and
    - (H) any other activity that the [Secretary](/usc/25/4302.md?p=9), in consultation with the [Director](/usc/25/4302.md?p=1), determines to be appropriate to carry out this section.
  - (4) **Assistance—** In conjunction with the activities described in [paragraph (3)](#b-3), the [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall provide—
    - (A) financial assistance, technical assistance, and administrative services to [eligible entities](/usc/25/4302.md?p=2) to assist those entities with—
      - (i) identifying and taking advantage of business development opportunities; and
      - (ii) compliance with appropriate laws and regulatory practices; and
    - (B) such other assistance as the [Secretary](/usc/25/4302.md?p=9), in consultation with the [Director](/usc/25/4302.md?p=1), determines to be necessary for the development of business opportunities for [eligible entities](/usc/25/4302.md?p=2) to enhance the economies of [Indian Tribes](/usc/25/81.md?p=a-2).
  - (5) **Priorities—** In carrying out the duties and activities described in paragraphs [(3)](#b-3) and [(4)](#b-4), the [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall give priority to activities that—
    - (A) provide the greatest degree of economic benefits to [Indians](/usc/25/1934.md); and
    - (B) foster long-term stable economies of [Indian Tribes](/usc/25/81.md?p=a-2).
  - (6) **Prohibition—** The [Secretary](/usc/25/4302.md?p=9) may not provide under this section assistance for any activity related to the operation of a gaming activity on [Indian lands](/usc/25/4302.md?p=5-A) pursuant to the [Indian](/usc/25/1934.md) Gaming Regulatory Act [[25 U.S.C. 2701](/usc/25/2701.md) et seq.].
- (c) **Duties of Director—**
  - (1) **In general—** The [Director](/usc/25/4302.md?p=1) shall serve as—
    - (A) the [program](/usc/25/3402.md?p=4) and policy advisor to the [Secretary](/usc/25/4302.md?p=9) with respect to the trust and governmental relationship between the United States and [Indian Tribes](/usc/25/81.md?p=a-2); and
    - (B) the point of contact for [Indian Tribes](/usc/25/81.md?p=a-2), [Tribal organizations](/usc/25/2902.md?p=5), and [Indians](/usc/25/1934.md) regarding—
      - (i) policies and [programs](/usc/25/3402.md?p=4) of the Department of Commerce; and
      - (ii) other matters relating to economic development and doing business in [Indian lands](/usc/25/4302.md?p=5-A).
  - (2) **Departmental coordination—** The [Director](/usc/25/4302.md?p=1) shall coordinate with all [offices](/usc/25/4001.md?p=4) and agencies within the Department of Commerce to ensure that each [office](/usc/25/4001.md?p=4) and agency has an accountable process to ensure—
    - (A) meaningful and timely coordination and assistance, as required by this chapter; and
    - (B) consultation with [Indian Tribes](/usc/25/81.md?p=a-2) regarding the policies, [programs](/usc/25/3402.md?p=4), assistance, and activities of the [offices](/usc/25/4001.md?p=4) and agencies.
  - (3) **Office operations—** There are authorized to be appropriated to carry out this section not more than $2,000,000 for each fiscal year.

# §4304. Native American trade and export promotion

- (a) **In general—** The [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall carry out a [Native American](/usc/25/5802.md?p=5) export and trade promotion [program](/usc/25/3402.md?p=4) (referred to in this section as the “[program](/usc/25/3402.md?p=4)”).
- (b) **Coordination of Federal programs and services—** In carrying out the [program](/usc/25/3402.md?p=4), the [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), and in cooperation with the heads of appropriate Federal agencies, shall ensure the coordination of Federal [programs](/usc/25/3402.md?p=4) and services designed to—
  - (1) develop the economies of [Indian Tribes](/usc/25/81.md?p=a-2); and
  - (2) stimulate the demand for [Indian goods and services](/usc/25/4302.md?p=4) that are available from [eligible entities](/usc/25/4302.md?p=2).
- (c) **Activities—** In carrying out the duties described in [subsection (b)](#b), the [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall ensure the coordination of, or, as appropriate, carry out—
  - (1) Federal [programs](/usc/25/3402.md?p=4) designed to provide technical or financial assistance to [eligible entities](/usc/25/4302.md?p=2);
  - (2) the development of promotional materials;
  - (3) the financing of appropriate trade missions;
  - (4) the marketing of [Indian goods and services](/usc/25/4302.md?p=4);
  - (5) the participation of appropriate Federal agencies or [eligible entities](/usc/25/4302.md?p=2) in international trade fairs; and
  - (6) any other activity related to the development of markets for [Indian goods and services](/usc/25/4302.md?p=4).
- (d) **Technical assistance—** In conjunction with the activities described in [subsection (c)](#c), the [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall provide technical assistance and administrative services to [eligible entities](/usc/25/4302.md?p=2) to assist those entities with—
  - (1) the identification of appropriate markets for [Indian goods and services](/usc/25/4302.md?p=4);
  - (2) entering the markets referred to in [paragraph (1)](#d-1);
  - (3) compliance with foreign or domestic laws and practices with respect to financial institutions with respect to the export and import of [Indian goods and services](/usc/25/4302.md?p=4); and
  - (4) entering into financial arrangements to provide for the export and import of [Indian goods and services](/usc/25/4302.md?p=4).
- (e) **Priorities—** In carrying out the duties and activities described in subsections [(b)](#b) and [(c)](#c), the [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall give priority to activities that—
  - (1) provide the greatest degree of economic benefits to [Indians](/usc/25/1934.md); and
  - (2) foster long-term stable international markets for [Indian goods and services](/usc/25/4302.md?p=4).

# §4305. Intertribal tourism demonstration projects

- (a) **Program to conduct tourism projects—**
  - (1) **In general—** The [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall conduct a [Native American](/usc/25/5802.md?p=5) tourism [program](/usc/25/3402.md?p=4) to facilitate the development and conduct of tourism [demonstration projects](/usc/25/1667a.md?p=2) by [Indian Tribes](/usc/25/81.md?p=a-2), on a Tribal, intertribal, or regional basis.
  - (2) **Demonstration projects—**
    - (A) **In general—** Under the [program](/usc/25/3402.md?p=4) established under this section, in order to assist in the development and promotion of tourism on and in the vicinity of [Indian lands](/usc/25/4302.md?p=5-A), the [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall, in coordination with the [Under Secretary](/usc/25/5632.md?p=4) of Agriculture for Rural Development, assist [eligible entities](/usc/25/4302.md?p=2) in the planning, development, and implementation of tourism development [demonstration projects](/usc/25/1667a.md?p=2) that meet the criteria described in [subparagraph (B)](#a-2-B).
    - (B) **Projects described—** In selecting tourism development [demonstration projects](/usc/25/1667a.md?p=2) under this section, the [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall select [projects](/usc/25/5611.md?p=2) that have the potential to increase travel and tourism revenues by attracting visitors to [Indian lands](/usc/25/4302.md?p=5-A) and lands in the vicinity of [Indian lands](/usc/25/4302.md?p=5-A), including [projects](/usc/25/5611.md?p=2) that provide for—
      - (i) the development and distribution of educational and promotional materials pertaining to attractions located on and near [Indian lands](/usc/25/4302.md?p=5-A);
      - (ii) the development of educational resources to assist in private and public tourism development on and in the vicinity of [Indian lands](/usc/25/4302.md?p=5-A); and
      - (iii) the coordination of tourism-related joint ventures and cooperative efforts between [eligible entities](/usc/25/4302.md?p=2) and appropriate State and local governments that have jurisdiction over areas in the vicinity of [Indian lands](/usc/25/4302.md?p=5-A).
  - (3) **Grants—** To carry out the [program](/usc/25/3402.md?p=4) under this section, the [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), may award grants or enter into other appropriate arrangements with [Indian Tribes](/usc/25/81.md?p=a-2), [Tribal organizations](/usc/25/2902.md?p=5), intertribal consortia, or other Tribal entities that the [Secretary](/usc/25/4302.md?p=9), in consultation with the [Director](/usc/25/4302.md?p=1), determines to be appropriate.
  - (4) **Locations—** In providing for tourism development [demonstration projects](/usc/25/1667a.md?p=2) under the [program](/usc/25/3402.md?p=4) under this section, the [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall provide for a [demonstration project](/usc/25/1667a.md?p=2) to be conducted—
    - (A) for [Indians](/usc/25/1934.md) of the Four Corners area located in the area adjacent to the border between Arizona, Utah, Colorado, and New Mexico;
    - (B) for [Indians](/usc/25/1934.md) of the northwestern area that is commonly known as the Great Northwest (as determined by the [Secretary](/usc/25/4302.md?p=9));
    - (C) for the Oklahoma [Indians](/usc/25/1934.md) in Oklahoma;
    - (D) for the [Indians](/usc/25/1934.md) of the Great Plains area (as determined by the [Secretary](/usc/25/4302.md?p=9)); and
    - (E) for Alaska [Natives](/usc/25/5802.md?p=5) in Alaska.
- (b) **Assistance—** The [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), shall provide financial assistance, technical assistance, and administrative services to participants that the [Secretary](/usc/25/4302.md?p=9), acting through the [Director](/usc/25/4302.md?p=1), selects to carry out a tourism development [project](/usc/25/5611.md?p=2) under this section, with respect to—
  - (1) feasibility studies conducted as part of that [project](/usc/25/5611.md?p=2);
  - (2) market analyses;
  - (3) participation in tourism and trade missions; and
  - (4) any other activity that the [Secretary](/usc/25/4302.md?p=9), in consultation with the [Director](/usc/25/4302.md?p=1), determines to be appropriate to carry out this section.
- (c) **Infrastructure development—** The [demonstration projects](/usc/25/1667a.md?p=2) conducted under this section shall include provisions to facilitate the development and financing of infrastructure, including the development of [Indian reservation](/usc/25/2902.md?p=8) roads in a manner consistent with [title 23](/usc/23.md).
