# §1680r. Tribal health program option for cost sharing

- (a) **In general—** Nothing in this chapter limits the ability of a [tribal health program](/usc/25/1603.md?p=25) operating any health program, [service](/usc/25/1603.md?p=18), function, activity, or facility funded, in whole or part, by the [Service](/usc/25/1603.md?p=18) through, or provided for in, a compact with the [Service](/usc/25/1603.md?p=18) pursuant to title V of the [Indian](/usc/25/1603.md?p=13) Self-Determination and Education Assistance Act ([25 U.S.C. 458aaa](/usc/25/458aaa.md) et seq.)[^1] to charge an [Indian](/usc/25/1603.md?p=13) for [services](/usc/25/1603.md?p=18) provided by the [tribal health program](/usc/25/1603.md?p=25).
- (b) **Service—** Nothing in this chapter authorizes the [Service](/usc/25/1603.md?p=18)—
  - (1) to charge an [Indian](/usc/25/1603.md?p=13) for [services](/usc/25/1603.md?p=18); or
  - (2) to require any [tribal health program](/usc/25/1603.md?p=25) to charge an [Indian](/usc/25/1603.md?p=13) for [services](/usc/25/1603.md?p=18).
