# §1678a. North Dakota and South Dakota as contract health service delivery area

- (a) **In general—** The States of North Dakota and South Dakota shall be designated as a [contract health service](/usc/25/1603.md?p=5) delivery area by the [Service](/usc/25/1603.md?p=18) for the purpose of providing contract health care [services](/usc/25/1603.md?p=18) to members of [Indian tribes](/usc/25/1603.md?p=14) in the States of North Dakota and South Dakota.
- (b) **Maintenance of services—** The [Service](/usc/25/1603.md?p=18) shall not curtail any health care [services](/usc/25/1603.md?p=18) provided to [Indians](/usc/25/1603.md?p=13) residing on any [reservation](/usc/25/1603.md?p=16-A), or in any county that has a common boundary with any [reservation](/usc/25/1603.md?p=16-A), in the State of North Dakota or South Dakota if the curtailment is due to the provision of contract [services](/usc/25/1603.md?p=18) in those States pursuant to the designation of the States as a [contract health service](/usc/25/1603.md?p=5) delivery area by [subsection (a)](#a).
