# §406. General requirements for Federal assistance

- (a) **Definition of Funded Project.—** In this section, the term “funded [project](/usc/23/101.md?p=a-20)” means a [project](/usc/23/101.md?p=a-20) funded, in whole or in part, by a grant provided under section [402](/usc/23/402.md) or 405.
- (b) **Regulatory Authority.—** Each funded [project](/usc/23/101.md?p=a-20) shall be carried out in accordance with applicable regulations promulgated by the [Secretary](/usc/23/101.md?p=a-27).
- (c) **State Matching Requirements.—** If a grant provided under this chapter requires any [State](/usc/23/101.md?p=a-28) to share in the cost of a funded [project](/usc/23/101.md?p=a-20), the aggregate of the expenditures made by the [State](/usc/23/101.md?p=a-28) (including any political subdivision of the [State](/usc/23/101.md?p=a-28)) for [highway](/usc/23/101.md?p=a-11) safety activities during a fiscal year, exclusive of Federal funds, for carrying out the funded [project](/usc/23/101.md?p=a-20) (other than expenditures for planning or administration) shall be credited toward the non-Federal share of the cost of any other funded [project](/usc/23/101.md?p=a-20) (other than planning and administration) during that fiscal year, regardless of whether those expenditures were made in connection with the [project](/usc/23/101.md?p=a-20).
- (d) **Grant Application and Deadline.—**
  - (1) **Applications.—** To be eligible to receive a grant under this chapter, a [State](/usc/23/101.md?p=a-28) shall submit to the [Secretary](/usc/23/101.md?p=a-27) an application at such time, in such manner, and containing such information as the [Secretary](/usc/23/101.md?p=a-27) may require.
  - (2) **Deadline.—** The [Secretary](/usc/23/101.md?p=a-27) shall establish a single deadline for the submission of applications under [paragraph (1)](#d-1) to enable the provision of grants under this chapter early in each applicable fiscal year beginning after the date of submission.
- (e) **Distribution of Funds to States.—** Not later than 60 days after the later of the start of a fiscal year or the date of enactment of any appropriations Act making funds available to carry out this chapter for that fiscal year, the [Secretary](/usc/23/101.md?p=a-27) shall distribute to each [State](/usc/23/101.md?p=a-28) the portion of those funds to which the [State](/usc/23/101.md?p=a-28) is entitled for the applicable fiscal year.
