# §8515. Prohibition on procurement contracts with persons that export sensitive technology to Iran

- (a) **In general—** Except as provided in [subsection (b)](#b), and pursuant to such regulations as the President may prescribe, the head of an [executive agency](/usc/22/8511.md?p=3) may not enter into or renew a contract, on or after the date that is 90 days after July 1, 2010, for the procurement of goods or services with a person that exports sensitive technology to Iran.
- (b) **Authorization to exempt certain products—** The President is authorized to exempt from the prohibition under [subsection (a)](#a) only eligible products, as defined in [section 2518(4) of title 19](/usc/19/2518.md?p=4), of any [foreign country](/usc/22/2321c.md?p=2) or instrumentality designated under [section 2511(b) of title 19](/usc/19/2511.md?p=b).
- (c) **Sensitive technology defined—**
  - (1) **In general—** The term “sensitive technology” means hardware, software, telecommunications equipment, or any other technology, that the President determines is to be used specifically—
    - (A) to restrict the free flow of unbiased information in Iran; or
    - (B) to disrupt, monitor, or otherwise restrict speech of the people of Iran.
  - (2) **Exception—** The term “sensitive technology” does not include information or informational materials the exportation of which the President does not have the authority to regulate or prohibit pursuant to [section 1702(b)(3) of title 50](/usc/50/1702.md?p=b-3).
- (d) **Government Accountability Office report on effect of procurement prohibition—** Not later than 1 year after July 1, 2010, the Comptroller General of the United States shall submit to the [appropriate congressional committees](/usc/22/8511.md?p=2), the Committee on Armed Services of the Senate, and the Committee on Armed Services of the House of Representatives, a report assessing the extent to which [executive agencies](/usc/22/8511.md?p=3) would have entered into or renewed contracts for the procurement of goods or services with persons that export sensitive technology to Iran if the prohibition under [subsection (a)](#a) were not in effect.
