# §6611. Reorganization authority

- (a) **In general—** The [Secretary](/usc/22/6502.md?p=10) is authorized, subject to the requirements of this chapter, to allocate or reallocate any [function](/usc/22/6502.md?p=7) transferred to the [Department](/usc/22/6502.md?p=6) under any subchapter of this chapter, and to establish, consolidate, alter, or discontinue such organizational entities within the [Department](/usc/22/6502.md?p=6) as may be necessary or appropriate to carry out any reorganization under this chapter, but this subsection does not authorize the [Secretary](/usc/22/6502.md?p=10) to modify the terms of any statute that establishes or defines the [functions](/usc/22/6502.md?p=7) of any bureau, [office](/usc/22/6502.md?p=9), or officer of the [Department](/usc/22/6502.md?p=6).
- (b) **Requirements and limitations on reorganization plan—** The reorganization plan transmitted under [section 6601 of this title](/usc/22/6601.md) may not have the effect of—
  - (1) creating a new executive [department](/usc/22/6502.md?p=6);
  - (2) continuing a [function](/usc/22/6502.md?p=7) beyond the period authorized by law for its exercise or beyond the time when it would have terminated if the reorganization had not been made;
  - (3) authorizing a [Federal agency](/usc/22/6502.md?p=3) to exercise a [function](/usc/22/6502.md?p=7) which is not authorized by law at the time the plan is transmitted to Congress;
  - (4) creating a new [Federal agency](/usc/22/6502.md?p=3) which is not a component or part of an existing executive [department](/usc/22/6502.md?p=6) or independent [agency](/usc/22/6502.md?p=3); or
  - (5) increasing the term of an [office](/usc/22/6502.md?p=9) beyond that provided by law for the [office](/usc/22/6502.md?p=9).
