# §4112. Employees represented


The [employees](/usc/22/4102.md?p=8) of the [Department](/usc/22/3902.md?p=4) shall constitute a single and separate worldwide bargaining unit, from which there shall be excluded—

- (1) [employees](/usc/22/4102.md?p=8) engaged in personnel work in other than a purely clerical capacity; and
- (2) [employees](/usc/22/4102.md?p=8) engaged in criminal or national security investigations or who audit the work of individuals to insure that their [functions](/usc/22/3902.md?p=6) are discharged honestly and with integrity.
