# §4104. Employee rights

- (a) Every [employee](/usc/22/4102.md?p=8) has the right to form, join, or assist any [labor organization](/usc/22/4102.md?p=11), or to refrain from any such activity, freely and without fear of penalty or reprisal. Each [employee](/usc/22/4102.md?p=8) shall be protected in the exercise of such right.
- (b) Except as otherwise provided under this subchapter, such right includes the right—
  - (1) to act for a [labor organization](/usc/22/4102.md?p=11) in the capacity of a representative and, in that capacity, to present the views of the [labor organization](/usc/22/4102.md?p=11) to the [Secretary](/usc/22/3902.md?p=10) and other officials of the [Government](/usc/22/3902.md?p=7), including the Congress, or other appropriate [authorities](/usc/22/4102.md?p=1); and
  - (2) to engage in [collective bargaining](/usc/22/4102.md?p=3) with respect to [conditions of employment](/usc/22/4102.md?p=5) through representatives chosen by [employees](/usc/22/4102.md?p=8) under this subchapter.
