# §364i. Exemption for certain products and facilities

- (a) **In general—** Notwithstanding any other provision of law, except as provided in [subsection (b)](#b), a [cosmetic product](/usc/21/364.md?p=2) or [facility](/usc/21/364.md?p=3-A) that is also subject to the requirements of subchapter V shall be exempt from the requirements of sections [364a](/usc/21/364a.md), [364b](/usc/21/364b.md), [364c](/usc/21/364c.md), [364d](/usc/21/364d.md), [364e(a)](/usc/21/364e.md?p=a), [364f](/usc/21/364f.md), and [364g](/usc/21/364g.md) of this title.
- (b) **Exception—** A [facility](/usc/21/364.md?p=3-A) described in [subsection (a)](#a) that also manufactures or processes [cosmetic products](/usc/21/364.md?p=2) that are not subject to the requirements of subchapter V shall not be exempt from the requirements of sections [364a](/usc/21/364a.md), [364b](/usc/21/364b.md), [364c](/usc/21/364c.md), [364d](/usc/21/364d.md), [364e(a)](/usc/21/364e.md?p=a), [364f](/usc/21/364f.md), and [364g](/usc/21/364g.md) of this title, with respect to such [cosmetic products](/usc/21/364.md?p=2).
