# §7912. Unsafe school choice option

- (a) **Unsafe school choice policy—** Each [State](/usc/20/7171.md?p=b-6) receiving funds under this chapter shall establish and implement a statewide policy requiring that a student attending a persistently dangerous public [elementary school](/usc/20/7801.md?p=19) or [secondary school](/usc/20/7801.md?p=45), as determined by the [State](/usc/20/7171.md?p=b-6) in consultation with a representative sample of [local educational agencies](/usc/20/7713.md?p=9-A), or who becomes a victim of a violent criminal offense, as determined by [State](/usc/20/7171.md?p=b-6) law, while in or on the grounds of a public [elementary school](/usc/20/7801.md?p=19) or [secondary school](/usc/20/7801.md?p=45) that the student attends, be allowed to attend a safe public [elementary school](/usc/20/7801.md?p=19) or [secondary school](/usc/20/7801.md?p=45) within the [local educational agency](/usc/20/7713.md?p=9-A), including a public [charter school](/usc/20/7221i.md?p=2).
- (b) **Certification—** As a condition of receiving funds under this chapter, a [State](/usc/20/7171.md?p=b-6) shall certify in writing to the [Secretary](/usc/20/7801.md?p=46) that the [State](/usc/20/7171.md?p=b-6) is in compliance with this section.
