# §6431. Eligibility


A [State](/usc/20/7171.md?p=b-6) agency is eligible for assistance under this subpart if such [State](/usc/20/7171.md?p=b-6) agency is responsible for providing [free public education](/usc/20/7491.md?p=2) for children and youth—

- (1) in institutions for neglected or delinquent children and youth;
- (2) attending [community day programs](/usc/20/6472.md?p=3) for neglected or delinquent children and youth; or
- (3) in [adult correctional institutions](/usc/20/6472.md?p=1).
