# §4709. Executive Secretary

- (a) **Appointment by Board—** There shall be an Executive [Secretary](/usc/20/1221.md?p=c-4) of the [Foundation](/usc/20/4702.md?p=1) who shall be appointed by the [Board](/usc/20/4702.md?p=2). The Executive [Secretary](/usc/20/1221.md?p=c-4) shall be the chief executive officer of the [Foundation](/usc/20/4702.md?p=1) and shall carry out the functions of the [Foundation](/usc/20/4702.md?p=1) subject to the supervision and direction of the [Board](/usc/20/4702.md?p=2). The Executive [Secretary](/usc/20/1221.md?p=c-4) shall carry out such other functions consistent with the provisions of this chapter as the [Board](/usc/20/4702.md?p=2) shall prescribe.
- (b) **Compensation—** The Executive [Secretary](/usc/20/1221.md?p=c-4) of the [Foundation](/usc/20/4702.md?p=1) shall serve as a noncareer appointee of the Senior Executive Service and shall be compensated at a rate determined by the [Board](/usc/20/4702.md?p=2) in accordance with [section 5383 of title 5](/usc/5/5383.md).
