# §1411. Effect of failure to issue regulations


In any proceeding under section [1405](/usc/2/1405.md), [1406](/usc/2/1406.md), [1407](/usc/2/1407.md), or [1408](/usc/2/1408.md) of this title, except a proceeding to enforce [section 1351 of this title](/usc/2/1351.md) with respect to [offices](/usc/2/1301.md?p=a-12) listed under [section 1351(e)(2) of this title](/usc/2/1351.md?p=e-2), if the [Board](/usc/2/1301.md?p=a-1) has not issued a regulation on a matter for which this chapter requires a regulation to be issued, the hearing officer, [Board](/usc/2/1301.md?p=a-1), or court, as the case may be, shall apply, to the extent necessary and appropriate, the most relevant substantive executive agency regulation promulgated to implement the statutory provision at issue in the proceeding.
