# §4391. Allocation and training of personnel


The [Commissioner](/usc/19/4301.md?p=3) shall, to the maximum extent possible, ensure that U.S. Customs and Border Protection—

- (1) employs sufficient personnel who have expertise in, and responsibility for, preventing and investigating the [entry](/usc/19/4361.md?p=4) of [covered merchandise](/usc/19/4361.md?p=2) into the customs territory of the [United States](/usc/19/1683.md?p=9) through [evasion](/usc/19/4361.md?p=5);
- (2) on the basis of [risk assessment](/usc/19/2575b.md?p=6) metrics, assigns sufficient personnel with primary responsibility for preventing the [entry](/usc/19/4361.md?p=4) of [covered merchandise](/usc/19/4361.md?p=2) into the customs territory of the [United States](/usc/19/1683.md?p=9) through [evasion](/usc/19/4361.md?p=5) to the ports of [entry](/usc/19/4361.md?p=4) in the [United States](/usc/19/1683.md?p=9) at which the [Commissioner](/usc/19/4301.md?p=3) determines potential [evasion](/usc/19/4361.md?p=5) presents the most substantial threats to the revenue of the [United States](/usc/19/1683.md?p=9); and
- (3) provides adequate training to relevant personnel to increase expertise and effectiveness in the prevention and identification of [entries](/usc/19/4361.md?p=4) of [covered merchandise](/usc/19/4361.md?p=2) into the customs territory of the [United States](/usc/19/1683.md?p=9) through [evasion](/usc/19/4361.md?p=5).
