# §2803. Designation of major wine trading countries

- (a) The [Trade Representative](/usc/19/2802.md?p=5) shall designate as a [major wine trading country](/usc/19/2802.md?p=3) each foreign [country](/usc/19/1677.md?p=3), or group of foreign [countries](/usc/19/1677.md?p=3) represented as an economic union, that, in the judgment of the [Trade Representative](/usc/19/2802.md?p=5)—
  - (1) is a potential significant market for [United States wine](/usc/19/2802.md?p=6); and
  - (2) maintains tariff barriers or nontariff barriers to (or other distortions of) trade in [United States wine](/usc/19/2802.md?p=6).
- (b) In deciding, for purposes of [subsection (a)(2)](#a-2), whether a foreign [country](/usc/19/1677.md?p=3) or group of [countries](/usc/19/1677.md?p=3) maintains nontariff barriers to (or other distortions of) trade in [United States wine](/usc/19/2802.md?p=6), the [Trade Representative](/usc/19/2802.md?p=5) shall take into account—
  - (1) the review and report required under section 854(a) of the Trade Agreements Act of 1979 ([19 U.S.C. 2135](/usc/19/2135.md) note);
  - (2) such relevant actions that may have been taken by that [country](/usc/19/1677.md?p=3) or group since that review was conducted; and
  - (3) such information as may be submitted under [section 2805 of this title](/usc/19/2805.md) by representatives of the [wine](/usc/19/2802.md?p=7) and [grape products](/usc/19/2802.md?p=2) [industries](/usc/19/1677.md?p=4-A) in the [United States](/usc/19/1683.md?p=9), as well as other sources.
