# §4104. Transfer of offenders on probation

- (a) Prior to consenting to the [transfer](/usc/18/4101.md?p=j) to the United States of an [offender](/usc/18/4101.md?p=e) who is on [probation](/usc/18/4101.md?p=g), the Attorney General shall determine that the appropriate United States district court is willing to undertake the supervision of the [offender](/usc/18/4101.md?p=e).
- (b) Upon the receipt of an [offender](/usc/18/4101.md?p=e) on [probation](/usc/18/4101.md?p=g) from the authorities of a foreign country, the Attorney General shall cause the [offender](/usc/18/4101.md?p=e) to be brought before the United States district court which is to exercise supervision over the [offender](/usc/18/4101.md?p=e).
- (c) The court shall place the [offender](/usc/18/4101.md?p=e) under supervision of the [probation](/usc/18/4101.md?p=g) officer of the court. The [offender](/usc/18/4101.md?p=e) shall be supervised by a [probation](/usc/18/4101.md?p=g) officer, under such conditions as are deemed appropriate by the court as though [probation](/usc/18/4101.md?p=g) had been imposed by the United States district court.
- (d) The [probation](/usc/18/4101.md?p=g) may be revoked in accordance with [section 3565 of this title](/usc/18/3565.md) and the applicable provisions of the Federal Rules of Criminal Procedure. A violation of the conditions of [probation](/usc/18/4101.md?p=g) shall constitute grounds for revocation. If [probation](/usc/18/4101.md?p=g) is revoked the suspended [sentence](/usc/18/4101.md?p=h) imposed by the sentencing court shall be executed.
- (e) The provisions of sections [4105](/usc/18/4105.md) and [4106](/usc/18/4106.md) of this title shall be applicable following a revocation of [probation](/usc/18/4101.md?p=g).
- (f) Prior to consenting to the [transfer](/usc/18/4101.md?p=j) from the United States of an [offender](/usc/18/4101.md?p=e) who is on [probation](/usc/18/4101.md?p=g), the Attorney General shall obtain the assent of the court exercising jurisdiction over the probationer.
