# §2337. Suits against Government officials


No action shall be maintained under [section 2333 of this title](/usc/18/2333.md) against—

- (1) the [United States](/usc/18/229F.md?p=9), an agency of the [United States](/usc/18/229F.md?p=9), or an [officer or employee](/usc/18/202.md?p=a) of the [United States](/usc/18/229F.md?p=9) or any agency thereof acting within his or her official capacity or under color of legal authority; or
- (2) a foreign [state](/usc/18/31.md?p=a-9), an agency of a foreign [state](/usc/18/31.md?p=a-9), or an [officer or employee](/usc/18/202.md?p=a) of a foreign [state](/usc/18/31.md?p=a-9) or an agency thereof acting within his or her official capacity or under color of legal authority.
