# §718t. Termination of State participation


The authority of a [State](/usc/16/718j.md?p=b-4) to issue [electronic stamps](/usc/16/718o.md?p=3) under this subchapter may be terminated—

- (1) by the [Secretary](/usc/16/718o.md?p=4), if the [Secretary](/usc/16/718o.md?p=4)—
  - (A) finds that the [State](/usc/16/718j.md?p=b-4) has violated any of the terms of the application of the [State](/usc/16/718j.md?p=b-4) approved by the [Secretary](/usc/16/718o.md?p=4) under [section 718q of this title](/usc/16/718q.md); and
  - (B) provides to the [State](/usc/16/718j.md?p=b-4) written notice of the termination by not later than the date that is 30 days before the date of termination; or
- (2) by the [State](/usc/16/718j.md?p=b-4), by providing written notice to the [Secretary](/usc/16/718o.md?p=4) by not later than the date that is 30 days before the termination date.
