# §460zzz–6. Advisory Council

- (a) **Establishment—** Not later than 180 days after March 30, 2009, the [Secretary](/usc/16/460iii–1.md?p=1) shall establish an advisory [council](/usc/16/460zzz.md?p=2), to be known as the “Dominguez-Escalante National [Conservation Area](/usc/16/460iii–1.md?p=2) Advisory [Council](/usc/16/460zzz.md?p=2)”.
- (b) **Duties—** The [Council](/usc/16/460zzz.md?p=2) shall advise the [Secretary](/usc/16/460iii–1.md?p=1) with respect to the preparation and implementation of the [management plan](/usc/16/460yyy.md?p=2).
- (c) **Applicable law—** The [Council](/usc/16/460zzz.md?p=2) shall be subject to—
  - (1) [chapter 10](/usc/5/chptI-ch10.md) of title 5; and
  - (2) the [Federal Land](/usc/16/3102.md?p=2) Policy and Management Act of 1976 ([43 U.S.C. 1701](/usc/43/1701.md) et seq.).
- (d) **Members—** The [Council](/usc/16/460zzz.md?p=2) shall include 10 members to be appointed by the [Secretary](/usc/16/460iii–1.md?p=1), of whom, to the extent practicable—
  - (1) 1 member shall be appointed after considering the recommendations of the Mesa County [Commission](/usc/16/544.md?p=c);
  - (2) 1 member shall be appointed after considering the recommendations of the Montrose County [Commission](/usc/16/544.md?p=c);
  - (3) 1 member shall be appointed after considering the recommendations of the Delta County [Commission](/usc/16/544.md?p=c);
  - (4) 1 member shall be appointed after considering the recommendations of the permittees holding grazing allotments within the [Conservation Area](/usc/16/460iii–1.md?p=2) or the [Wilderness](/usc/16/460zzz.md?p=7); and
  - (5) 5 members shall reside in, or within reasonable proximity to, Mesa County, Delta County, or Montrose County, Colorado, with backgrounds that reflect—
    - (A) the purposes for which the [Conservation Area](/usc/16/460iii–1.md?p=2) or [Wilderness](/usc/16/460zzz.md?p=7) was established; and
    - (B) the interests of the stakeholders that are affected by the planning and management of the [Conservation Area](/usc/16/460iii–1.md?p=2) and [Wilderness](/usc/16/460zzz.md?p=7).
- (e) **Representation—** The [Secretary](/usc/16/460iii–1.md?p=1) shall ensure that the membership of the [Council](/usc/16/460zzz.md?p=2) is fairly balanced in terms of the points of view represented and the functions to be performed by the [Council](/usc/16/460zzz.md?p=2).
- (f) **Duration—** The [Council](/usc/16/460zzz.md?p=2) shall terminate on the date that is 1 year from the date on which the [management plan](/usc/16/460yyy.md?p=2) is adopted by the [Secretary](/usc/16/460iii–1.md?p=1).
