# §460y–3. Procedure for establishment


The [Secretary](/usc/16/410r–5.md?p=c-1) shall establish the [Area](/usc/16/539m–1.md?p=1-A) after a period of at least ninety calendar days from and after the date that he has (1) submitted copies of the [program](/usc/16/460ss–6.md?p=1) required by [section 460y–2 of this title](/usc/16/460y–2.md) to the President of the Senate and the Speaker of the House of [Representatives](/usc/16/5609.md?p=13), the Governor of the [State](/usc/16/6456.md?p=2) of California, and the governing body of the county or [counties](/usc/16/544.md?p=d) in which the [area](/usc/16/539m–1.md?p=1-A) is located and (2) published a notice of intention to establish the [area](/usc/16/539m–1.md?p=1-A) in the Federal Register and in at least two newspapers which circulate generally within the [Area](/usc/16/539m–1.md?p=1-A).
