# §460rrr–4. Management plan

- (a) **In general—** Not later than 4 years after October 12, 2006, the [Secretary](/usc/16/460iii–1.md?p=1) and the [Commission](/usc/16/460rrr.md?p=1), in coordination with appropriate agencies in the [State](/usc/16/590q.md?p=a) of Colorado, political [subdivisions](/usc/16/539m–1.md?p=15) of the [State](/usc/16/590q.md?p=a), and private landowners in the [Natural Area](/usc/16/460rrr.md?p=2), shall prepare [management plans](/usc/16/544.md?p=k) for the [Natural Area](/usc/16/460rrr.md?p=2) as provided in [subsection (b)](#b).
- (b) **Duties of Secretary and Commission—**
  - (1) **Secretary—** The [Secretary](/usc/16/460iii–1.md?p=1) shall prepare a [management plan](/usc/16/544.md?p=k) relating to the management of [Federal land](/usc/16/3102.md?p=2) in the [Natural Area](/usc/16/460rrr.md?p=2).
  - (2) **Commission—**
    - (A) **In general—** The [Commission](/usc/16/460rrr.md?p=1) shall prepare a [management plan](/usc/16/544.md?p=k) relating to the management of the non-[Federal land](/usc/16/3102.md?p=2) in the [Natural Area](/usc/16/460rrr.md?p=2).
    - (B) **Approval or disapproval—**
      - (i) **In general—** The [Commission](/usc/16/460rrr.md?p=1) shall submit to the [Secretary](/usc/16/460iii–1.md?p=1) the [management plan](/usc/16/544.md?p=k) prepared under [subparagraph (A)](#b-2-A) for approval or disapproval.
      - (ii) **Action following disapproval—** If the [Secretary](/usc/16/460iii–1.md?p=1) disapproves the [management plan](/usc/16/544.md?p=k) submitted under [clause (i)](#b-2-B-i), the [Secretary](/usc/16/460iii–1.md?p=1) shall—
        - (I) notify the [Commission](/usc/16/460rrr.md?p=1) of the reasons for the disapproval; and
        - (II) allow the [Commission](/usc/16/460rrr.md?p=1) to submit to the [Secretary](/usc/16/460iii–1.md?p=1) revisions to the [management plan](/usc/16/544.md?p=k) submitted under [clause (i)](#b-2-B-i).
  - (3) **Cooperation—** The [Secretary](/usc/16/460iii–1.md?p=1) and the [Commission](/usc/16/460rrr.md?p=1) shall cooperate to ensure that the [management plans](/usc/16/544.md?p=k) relating to the management of [Federal land](/usc/16/3102.md?p=2) and non-[Federal land](/usc/16/3102.md?p=2) are consistent.
- (c) **Requirements—** The [management plans](/usc/16/544.md?p=k) shall—
  - (1) [take](/usc/16/3102.md?p=18) into consideration Federal, [State](/usc/16/590q.md?p=a), and local plans in existence on October 12, 2006, to present a unified preservation, restoration, and conservation plan for the [Natural Area](/usc/16/460rrr.md?p=2);
  - (2) with respect to [Federal land](/usc/16/3102.md?p=2) in the [Natural Area](/usc/16/460rrr.md?p=2)—
    - (A) be developed in accordance with [section 1712 of title 43](/usc/43/1712.md);
    - (B) be consistent, to the maximum extent practicable, with the [management plans](/usc/16/544.md?p=k) adopted by the Director of the Bureau of Land Management for land adjacent to the [Natural Area](/usc/16/460rrr.md?p=2); and
    - (C) be considered to be an amendment to the San Luis Resource [Management Plan](/usc/16/544.md?p=k) of the Bureau of Land Management; and
  - (3) include—
    - (A) an inventory of the resources contained in the [Natural Area](/usc/16/460rrr.md?p=2) (including a list of property in the [Natural Area](/usc/16/460rrr.md?p=2) that should be preserved, restored, managed, developed, maintained, or acquired to further the purposes of the [Natural Area](/usc/16/460rrr.md?p=2)); and
    - (B) a recommendation of policies for resource management, including the use of intergovernmental cooperative agreements, that—
      - (i) protect the resources of the [Natural Area](/usc/16/460rrr.md?p=2); and
      - (ii) provide for solitude, quiet use, and pristine natural values of the [Natural Area](/usc/16/460rrr.md?p=2).
- (d) **Publication—** The [Secretary](/usc/16/460iii–1.md?p=1) shall publish notice of the [management plans](/usc/16/544.md?p=k) in the Federal Register.
