# §460nnn–102. Land exchanges, C. M. Otley and Otley Brothers

- (a) **C. M. Otley exchange—**
  - (1) **Exchange authorized—** For the purpose of protecting and consolidating [Federal lands](/usc/16/620e.md?p=2) within the [Cooperative Management and Protection Area](/usc/16/460nnn.md?p=3), the [Secretary](/usc/16/460iii–1.md?p=1) may carry out a land exchange with C. M. Otley to convey all right, title, and interest of the United States in and to certain parcels of land under the jurisdiction of the Bureau of Land Management in the vicinity of Steens Mountain, Oregon, as depicted on the [map](/usc/16/430f–7.md?p=1) referred to in [section 460nnn–105(a) of this title](/usc/16/460nnn–105.md?p=a), consisting of a total of approximately 3,845 acres in exchange for the [private lands](/usc/16/620e.md?p=6) described in [paragraph (2)](#a-2).
  - (2) **Receipt of non-Federal lands—** As consideration for the conveyance of the [Federal lands](/usc/16/620e.md?p=2) referred to in [paragraph (1)](#a-1) and the disbursement referred to in [paragraph (3)](#a-3), C. M. Otley shall convey to the [Secretary](/usc/16/460iii–1.md?p=1) a parcel of land in the headwaters of Kiger gorge consisting of approximately 851 acres, as depicted on the [map](/usc/16/430f–7.md?p=1) referred to in [section 460nnn–105(a) of this title](/usc/16/460nnn–105.md?p=a), for inclusion in the [Wilderness Area](/usc/16/460nnn.md?p=10) and the no livestock grazing [area](/usc/16/539m–1.md?p=1-A) as appropriate.
  - (3) **Disbursement—** Upon completion of the land exchange authorized by this subsection, the [Secretary](/usc/16/460iii–1.md?p=1) is authorized to make a disbursement to C.M. Otley, in the amount of $920,000.
- (b) **Otley Brothers exchange—**
  - (1) **Exchange authorized—** For the purpose of protecting and consolidating [Federal lands](/usc/16/620e.md?p=2) within the [Cooperative Management and Protection Area](/usc/16/460nnn.md?p=3), the [Secretary](/usc/16/460iii–1.md?p=1) may carry out a land exchange with the Otley Brother’s, Inc., to convey all right, title, and interest of the United States in and to certain parcels of land under the jurisdiction of the Bureau of Land Management in the vicinity of Steens Mountain, Oregon, as depicted on the [map](/usc/16/430f–7.md?p=1) referred to in [section 460nnn–105(a) of this title](/usc/16/460nnn–105.md?p=a), consisting of a total of approximately 6,881 acres in exchange for the [private lands](/usc/16/620e.md?p=6) described in [paragraph (2)](#b-2).
  - (2) **Receipt of non-Federal lands—** As consideration for the conveyance of the [Federal lands](/usc/16/620e.md?p=2) referred to in [paragraph (1)](#b-1) and the disbursement referred to in subsection (3), the Otley Brother’s, Inc., shall convey to the [Secretary](/usc/16/460iii–1.md?p=1) a parcel of land in the headwaters of Kiger gorge consisting of approximately 505 acres, as depicted on the [map](/usc/16/430f–7.md?p=1) referred to in [section 460nnn–105(a) of this title](/usc/16/460nnn–105.md?p=a), for inclusion in the [Wilderness Area](/usc/16/460nnn.md?p=10) and the no livestock grazing [area](/usc/16/539m–1.md?p=1-A) as appropriate.
  - (3) **Disbursement—** Upon completion of the land exchange authorized by this subsection, the [Secretary](/usc/16/460iii–1.md?p=1) is authorized to make a disbursement to Otley Brother’s, Inc., in the amount of $400,000.
- (c) **Completion of conveyance—** The [Secretary](/usc/16/460iii–1.md?p=1) shall complete the conveyances of the [Federal lands](/usc/16/620e.md?p=2) under subsections [(a)](#a) and [(b)](#b) within 70 days after the [Secretary](/usc/16/460iii–1.md?p=1) accepts the lands described in such subsections.
