# §460mmm–6. Advisory Council

- (a) **Establishment—** Not later than 6 months after October 24, 2000, the [Secretary](/usc/16/460iii–1.md?p=1) shall establish an advisory [council](/usc/16/460mmm–1.md?p=2) to be known as the “McInnis Canyons National [Conservation Area](/usc/16/460iii–1.md?p=2) Advisory [Council](/usc/16/460mmm–1.md?p=2)”.
- (b) **Duty—** The [Council](/usc/16/460mmm–1.md?p=2) shall advise the [Secretary](/usc/16/460iii–1.md?p=1) with respect to preparation and implementation of the [management plan](/usc/16/460mmm–1.md?p=3), including budgetary matters, for the [Conservation Area](/usc/16/460iii–1.md?p=2) and the [Wilderness](/usc/16/460mmm–1.md?p=6).
- (c) **Applicable law—** The [Council](/usc/16/460mmm–1.md?p=2) shall be subject to—
  - (1) [chapter 10](/usc/5/chptI/ch10.md) of title 5; and
  - (2) the [Federal Land](/usc/16/3102.md?p=2) Policy and Management Act of 1976 ([43 U.S.C. 1701](/usc/43/1701.md) et seq.).
- (d) **Members—** The [Council](/usc/16/460mmm–1.md?p=2) shall consist of 10 members to be appointed by the [Secretary](/usc/16/460iii–1.md?p=1) including, to the extent practicable:
  - (1) A member of or nominated by the Mesa County [Commission](/usc/16/544.md?p=c).
  - (2) A member nominated by the permittees holding grazing allotments within the [Conservation Area](/usc/16/460iii–1.md?p=2) or the [Wilderness](/usc/16/460mmm–1.md?p=6).
  - (3) A member of or nominated by the Northwest Resource Advisory [Council](/usc/16/460mmm–1.md?p=2).
  - (4) Seven members residing in, or within reasonable proximity to, Mesa County, Colorado, with recognized backgrounds reflecting—
    - (A) the purposes for which the [Conservation Area](/usc/16/460iii–1.md?p=2) or [Wilderness](/usc/16/460mmm–1.md?p=6) was established; and
    - (B) the interests of the stakeholders that are affected by the planning and management of the [Conservation Area](/usc/16/460iii–1.md?p=2) and the [Wilderness](/usc/16/460mmm–1.md?p=6).

### Termination of Advisory Councils

Advisory councils established after Jan. 5, 1973, to terminate not later than the expiration of the 2-year period beginning on the date of their establishment, unless, in the case of a council established by the President or an officer of the Federal Government, such council is renewed by appropriate action prior to the expiration of such 2-year period, or in the case of a council established by Congress, its duration is otherwise provided by law.
