# §460jjj–4. Acquisition of land

- (a) **State land—** Land and interests in land within the boundaries of the recreation [area](/usc/16/539m–1.md?p=1-A) that are owned by the [State](/usc/16/590q.md?p=a) of New Mexico, or a political [subdivision](/usc/16/539m–1.md?p=15) of New Mexico, may be acquired only by donation or exchange.
- (b) **Offers to sell—**
  - (1) **In general—** Subject to [paragraph (2)](#b-2), the [Secretary](/usc/16/460iii–1.md?p=1) may [acquire](/usc/16/620e.md?p=1) land and interests in land within the boundaries of the recreation [area](/usc/16/539m–1.md?p=1-A) by donation, purchase with donated or appropriated funds, or exchange.
  - (2) **Limitation—** The [Secretary](/usc/16/460iii–1.md?p=1) may not [acquire](/usc/16/620e.md?p=1) lands within the recreation [area](/usc/16/539m–1.md?p=1-A) without the consent of the [owner](/usc/16/429b–3.md?p=4) thereof unless the [Secretary](/usc/16/460iii–1.md?p=1) has determined that such lands will be put to a use different from their use as of October 12, 1993, and that such [new use](/usc/16/539m–1.md?p=8-A) would be incompatible with the protection of the natural and cultural resources of the recreation [area](/usc/16/539m–1.md?p=1-A).
