# §450jj–5. Administration of Memorial; cooperation with State and local governments and private sector


Lands and interests in lands acquired pursuant to [section 450jj–3 of this title](/usc/16/450jj–3.md) shall, upon [acquisition](/usc/16/620e.md?p=1), be a part of the [Memorial](/usc/16/450ss–1.md?p=2). The [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior shall administer the [Memorial](/usc/16/450ss–1.md?p=2) in accordance with sections [450jj](/usc/16/450jj.md) to [450jj–9](/usc/16/450jj–9.md) of this title and the provisions of law generally applicable to [units](/usc/16/430f–7.md?p=4) of the national [park](/usc/16/410r–5.md?p=c-3) system, including the Act entitled “An Act to establish a National [Park](/usc/16/410r–5.md?p=c-3) Service, and for other purposes”, approved August 25, 1916 (39 Stat. 535; [16 U.S.C. 1–4](https://uscode.house.gov/view.xhtml?req=(/us/usc/t16/s1–4)))[^1] and the Act of August 21, 1935 (49 Stat. 666; [16 U.S.C. 461–467](https://uscode.house.gov/view.xhtml?req=(/us/usc/t16/s461–467))).[^1] In the development, management, and operation of that portion of the [Memorial](/usc/16/450ss–1.md?p=2) which is added to the [Memorial](/usc/16/450ss–1.md?p=2) under [section 450jj–3 of this title](/usc/16/450jj–3.md), the [Secretary](/usc/16/410r–5.md?p=c-1) shall, to the maximum extent feasible, utilize the assistance of [State](/usc/16/590q.md?p=a) and local government agencies and the private sector. For such purposes, the [Secretary](/usc/16/410r–5.md?p=c-1) may, consistent with the [management plan](/usc/16/544.md?p=k) for the [area](/usc/16/539m–1.md?p=1-A), enter into cooperative agreements with the [State](/usc/16/590q.md?p=a), with any political [subdivision](/usc/16/539m–1.md?p=15) of the [State](/usc/16/590q.md?p=a), or with any [person](/usc/16/450rr–1.md?p=b). Any such cooperative agreement shall, at a minimum, establish procedures for providing notice to the [Secretary](/usc/16/410r–5.md?p=c-1) of any action proposed by the [State](/usc/16/590q.md?p=a), such political [subdivision](/usc/16/539m–1.md?p=15), or such [person](/usc/16/450rr–1.md?p=b), which may affect the [area](/usc/16/539m–1.md?p=1-A).
