# §430kk. Wilson’s Creek National Battlefield: establishment and acquisition of lands

- (a) **Establishment, initial boundaries—** The [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior shall [acquire](/usc/16/620e.md?p=1), by gift, purchase, condemnation, or otherwise, the lands (together with any improvements thereon) comprising the Wilson’s Creek Battlefield site near Springfield, Missouri, and any other lands adjacent to such site which in his opinion are necessary or desirable to carry out the purposes of [sections 430kk to 430mm](/usc/16/430kk..430mm.md) of this title.
- (b) **Expansion of boundaries—**
  - (1) **Additional land—**
    - (A) **In general—** The boundaries of the Wilson’s Creek National Battlefield are revised to include lands and interests therein consisting of six parcels totaling 615 acres and identified as parcels “1, 2, 3, 4, 5, and 6” on the [map](/usc/16/430f–7.md?p=1) entitled “Wilson’s Creek National Battlefield Proposed Boundary”, numbered 410/80,037 and dated January 27, 2004.
    - (B) **Newtonia Battlefield addition—** The boundary of the Wilson’s Creek National Battlefield is revised to include the approximately 25 acres of land identified as “Proposed [Addition](/usc/16/410r–5.md?p=c-2)” on the [map](/usc/16/430f–7.md?p=1) entitled “Wilson’s Creek National Battlefield Proposed Boundary Modification”, numbered 410/177,379, and dated July 2022.
    - (C) **Availability of maps—** The [maps](/usc/16/430f–7.md?p=1) described in subparagraphs [(A)](#b-1-A) and [(B)](#b-1-B) shall be on file and available for public inspection in the appropriate offices of the [National Park](/usc/16/410hhh–1.md?p=5) Service.
    - (D) **Errors—** The [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior may correct any clerical or typographical error in a [map](/usc/16/430f–7.md?p=1) described in subparagraph [(A)](#b-1-A) or [(B)](#b-1-B).
  - (2) **Method of acquisition—** The [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior may [acquire](/usc/16/620e.md?p=1) the land described in subparagraphs [(A)](#b-1-A) and [(B)](#b-1-B) of paragraph (1) by donation, by purchase from willing sellers with donated or appropriated [funds](/usc/16/1421h.md?p=2), or by exchange. The [Secretary](/usc/16/410r–5.md?p=c-1) may [acquire](/usc/16/620e.md?p=1) by the same methods personal property associated with, and appropriate for, interpretation of Wilson’s Creek National Battlefield.
- (c) **Access to private property—** Nothing in [sections 430kk to 430mm](/usc/16/430kk..430mm.md) of this title shall be construed to—
  - (1) require any private property [owner](/usc/16/429b–3.md?p=4) to allow public access (including Federal, [State](/usc/16/6456.md?p=2), or local government access) to such private property; or
  - (2) modify any provision of Federal, [State](/usc/16/6456.md?p=2), or local law with regard to public access to or use of private property.
- (d) **Liability—** The revision of the boundaries of the Wilson’s Creek National Battlefield by [subsection (b)](#b) shall not be considered to create any liability for, or to have any effect on any liability under any other law of, any [owner](/usc/16/429b–3.md?p=4) of private property with respect to any [person](/usc/16/450rr–1.md?p=b) injured on that private property.
- (e) **Recognition of authority to control land use—** Nothing in [sections 430kk to 430mm](/usc/16/430kk..430mm.md) of this title shall be construed to modify the authority of Federal, [State](/usc/16/6456.md?p=2), or local governments to regulate [land use](/usc/16/1453.md?p=10).
- (f) **Participation of private property owners—** Nothing in [sections 430kk to 430mm](/usc/16/430kk..430mm.md) of this title shall be construed to require the [owner](/usc/16/429b–3.md?p=4) of any private property located within the boundaries of the Wilson’s Creek National Battlefield to participate in, or be associated with, the National Battlefield.
- (g) **Effect of expansion—** The boundaries of the Wilson’s Creek National Battlefield, as revised by [subsection (b)](#b), represent the [area](/usc/16/539m–1.md?p=1-A) within which Federal [funds](/usc/16/1421h.md?p=2) appropriated for the purpose of [sections 430kk to 430mm](/usc/16/430kk..430mm.md) of this title may be expended. The boundary revision shall not be construed to provide any nonexisting regulatory authority on [land use](/usc/16/1453.md?p=10) within the National Battlefield or its viewshed by the [Secretary](/usc/16/410r–5.md?p=c-1) or the [National Park](/usc/16/410hhh–1.md?p=5) Service.

# §430ll. Designation

- (a) **Administration, protection, and development—** The lands acquired under [section 430kk of this title](/usc/16/430kk.md) shall be set aside as a public [park](/usc/16/410r–5.md?p=c-3) for the benefit and enjoyment of the people of the United States, and shall be designated as the Wilson’s Creek National Battlefield. The [National Park](/usc/16/410hhh–1.md?p=5) Service, under the direction of the [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior, shall administer, protect, and develop the [park](/usc/16/410r–5.md?p=c-3), subject to the provisions of the Act entitled “An Act to establish a [National Park](/usc/16/410hhh–1.md?p=5) Service, and for other purposes”, approved August 25, 1916 (39 Stat. 535).[^1]
- (b) **Improvements—** In order to provide for the proper development and maintenance of the [park](/usc/16/410r–5.md?p=c-3), the [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior shall construct and maintain therein such roads, trails, markers, buildings, and other improvements, and such facilities for the care and accommodation of visitors, as he may deem necessary.

# §430mm. Authorization of appropriations


For development of the Wilson’s Creek National Battlefield, there are authorized to be appropriated not more than $5,640,000. There are authorized to be appropriated such sums as may be necessary to carry out [section 430kk(b) of this title](/usc/16/430kk.md?p=b).
