# §410zz–2. Expansion of boundaries

- (a) **In general—**
  - (1) The boundaries of the [park](/usc/16/410r–5.md?p=c-3) are hereby modified to reflect the [addition](/usc/16/410r–5.md?p=c-2) of approximately 3,460 acres of land and interests therein as generally depicted on the [map](/usc/16/430f–7.md?p=1) entitled “Saguaro National Monument [Additions](/usc/16/410r–5.md?p=c-2)” and dated April, 1994.
  - (2)
    - (A) The boundaries of the [park](/usc/16/410r–5.md?p=c-3) are further modified to include approximately 1,152 acres, as generally depicted on the [map](/usc/16/430f–7.md?p=1) titled “Saguaro National [Park](/usc/16/410r–5.md?p=c-3) Proposed Boundary Adjustment”, numbered 151/80,045G, and dated December 2020.
    - (B) The [map](/usc/16/430f–7.md?p=1) referred to in [subparagraph (A)](#a-2-A) shall be on file and available for inspection in the appropriate offices of the National [Park](/usc/16/410r–5.md?p=c-3) Service.
- (b) **Land acquisition—**
  - (1) Within the lands added to the [park](/usc/16/410r–5.md?p=c-3) pursuant to [subsection (a)](#a), the [Secretary](/usc/16/410r–5.md?p=c-1) is authorized to [acquire](/usc/16/620e.md?p=1) lands and interests therein by donation, purchase with donated or appropriated funds, transfer, or exchange: Provided, That no such lands or interests therein may be acquired without the consent of the [owner](/usc/16/429b–3.md?p=4) thereof unless the [Secretary](/usc/16/410r–5.md?p=c-1) determines that the land is being developed, or is proposed to be developed in a manner which is determental[^1] to the integrity of the [park](/usc/16/410r–5.md?p=c-3).
  - (2) The [Secretary](/usc/16/410r–5.md?p=c-1) may, with the consent of the [State](/usc/16/590q.md?p=a) of Arizona and in accordance with Federal and [State](/usc/16/590q.md?p=a) law, [acquire](/usc/16/620e.md?p=1) land or interests therein owned by the [State](/usc/16/590q.md?p=a) of Arizona within the boundary of the [park](/usc/16/410r–5.md?p=c-3).
  - (3) If the [Secretary](/usc/16/410r–5.md?p=c-1) is unable to [acquire](/usc/16/620e.md?p=1) the [State](/usc/16/590q.md?p=a) land under [paragraph (2)](#b-2), the [Secretary](/usc/16/410r–5.md?p=c-1) may enter into an agreement with the [State](/usc/16/590q.md?p=a) that would allow the National [Park](/usc/16/410r–5.md?p=c-3) Service to manage [State](/usc/16/590q.md?p=a) land within the boundary of the [park](/usc/16/410r–5.md?p=c-3).
- (c) **Withdrawal—** Subject to valid existing rights, all [Federal lands](/usc/16/620e.md?p=2) within the [park](/usc/16/410r–5.md?p=c-3) are hereby withdrawn from all forms of entry, appropriation, or disposal under the public land laws, from location, entry, or patent under the United States mining laws, and from disposition under all laws relating to mineral and geothermal leasing, and mineral materials, and all amendments thereto.
