# §410xxx. Ste. Genevieve National Historical Park

- (a) **Definitions—** In this section:
  - (1) **Historic District—** The term “Historic District” means the Ste. Genevieve Historic District National Historic Landmark, as generally depicted on the [Map](/usc/16/430f–7.md?p=1).
  - (2) **Historical Park—** The term “Historical [Park](/usc/16/410r–5.md?p=c-3)” means the Ste. Genevieve National Historical [Park](/usc/16/410r–5.md?p=c-3) established by [subsection (b)](#b).
  - (3) **Map—** The term “[Map](/usc/16/430f–7.md?p=1)” means the [map](/usc/16/430f–7.md?p=1) entitled “Ste. Genevieve National Historical [Park](/usc/16/410r–5.md?p=c-3) Proposed Boundary [Addition](/usc/16/410r–5.md?p=c-2)”, numbered 571/177,464, and dated September 2021.
  - (4) **Secretary—** The term “[Secretary](/usc/16/410r–5.md?p=c-1)” means the [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior.
  - (5) **Special resource study—** The term “special resource study” means the study entitled “Ste. Genevieve Final Special Resources Study and Environmental Assessment, Missouri” and dated May 2016.
  - (6) **State—** The term “[State](/usc/16/590q.md?p=a)” means the [State](/usc/16/590q.md?p=a) of Missouri.
- (b) **Establishment—**
  - (1) **In general—** Subject to [paragraph (2)](#b-2), there is established the Ste. Genevieve National Historical [Park](/usc/16/410r–5.md?p=c-3) in the [State](/usc/16/590q.md?p=a) as a [unit](/usc/16/430f–7.md?p=4) of the National [Park](/usc/16/410r–5.md?p=c-3) System to [preserve](/usc/16/698u–1.md?p=2), protect, and interpret for the benefit of present and future generations the themes of French settlement, vernacular architecture, and community form and farming on the frontier associated with Ste. Genevieve.
  - (2) **Conditions for establishment—** The Historical [Park](/usc/16/410r–5.md?p=c-3) shall not be established until the date on which the [Secretary](/usc/16/410r–5.md?p=c-1) determines that—
    - (A) sufficient land has been acquired for the Historical [Park](/usc/16/410r–5.md?p=c-3) to constitute a manageable [unit](/usc/16/430f–7.md?p=4); and
    - (B) the [Secretary](/usc/16/410r–5.md?p=c-1) has entered into a written agreement providing that land owned by the [State](/usc/16/590q.md?p=a), the City of Ste. Genevieve, or other entity within the Historic District shall be managed consistent with the purposes of this section.
- (c) **Boundaries—** The boundaries of the Historical [Park](/usc/16/410r–5.md?p=c-3) shall be the boundaries generally depicted on the [Map](/usc/16/430f–7.md?p=1).
- (d) **Availability of Map—**
  - (1) **In general—** The [Map](/usc/16/430f–7.md?p=1) shall be on file and available for public inspection in the appropriate offices of the National [Park](/usc/16/410r–5.md?p=c-3) Service.
  - (2) **Authority to correct errors—** The [Secretary](/usc/16/410r–5.md?p=c-1) may correct any clerical or typographical errors in the [Map](/usc/16/430f–7.md?p=1).
- (e) **Acquisition authority—**
  - (1) **In general—** The [Secretary](/usc/16/410r–5.md?p=c-1) may [acquire](/usc/16/620e.md?p=1) any land or interest in land located within the boundary of the Historical [Park](/usc/16/410r–5.md?p=c-3) or any nationally significant property identified in the special resource study within the Historic District by—
    - (A) donation;
    - (B) purchase with donated or appropriated funds; or
    - (C) exchange.
  - (2) **Boundary revision—** On the [acquisition](/usc/16/620e.md?p=1) of any property within the Historic District under [paragraph (1)](#e-1), the [Secretary](/usc/16/410r–5.md?p=c-1) shall revise the boundary of the Historical [Park](/usc/16/410r–5.md?p=c-3) to include the property.
  - (3) **Visitor center—** The [Secretary](/usc/16/410r–5.md?p=c-1)—
    - (A) may [acquire](/usc/16/620e.md?p=1), by donation, the land (including any improvements to the land) owned by the city of Ste. Genevieve, Missouri, and used as the visitor center for the Historical [Park](/usc/16/410r–5.md?p=c-3), as generally depicted on the [Map](/usc/16/430f–7.md?p=1) as “Proposed Boundary [Addition](/usc/16/410r–5.md?p=c-2)”; and
    - (B) on [acquisition](/usc/16/620e.md?p=1) of the land described in [subparagraph (A)](#e-3-A), shall revise the boundary of the Historical [Park](/usc/16/410r–5.md?p=c-3) to include the acquired land.
  - (4) **Administrative facilities—** The [Secretary](/usc/16/410r–5.md?p=c-1) may [acquire](/usc/16/620e.md?p=1), by purchase from a willing seller or by donation, not more than 20 acres of land in the vicinity of the Historical [Park](/usc/16/410r–5.md?p=c-3) for administrative facilities for the Historical [Park](/usc/16/410r–5.md?p=c-3).
- (f) **Administration—**
  - (1) **In general—** The [Secretary](/usc/16/410r–5.md?p=c-1) shall administer the Historical [Park](/usc/16/410r–5.md?p=c-3) in accordance with—
    - (A) this section; and
    - (B) the laws generally applicable to [units](/usc/16/430f–7.md?p=4) of the National [Park](/usc/16/410r–5.md?p=c-3) System, including—
      - (i) section 100101(a), chapter 1003, and sections [100751(a)](/usc/54/100751.md?p=a), [100752](/usc/54/100752.md), [100753](/usc/54/100753.md), and [102101](/usc/54/102101.md) of title 54; and
      - (ii) chapter 3201 of title 54.
  - (2) **Management plan—**
    - (A) **In general—** Not later than 3 years after the date on which funds are made available to prepare a general [management plan](/usc/16/544.md?p=k) for the Historical [Park](/usc/16/410r–5.md?p=c-3), the [Secretary](/usc/16/410r–5.md?p=c-1) shall prepare the general [management plan](/usc/16/544.md?p=k) in accordance with [section 100502 of title 54](/usc/54/100502.md).
    - (B) **Submission to Congress—** On completion of the general [management plan](/usc/16/544.md?p=k) under [subparagraph (A)](#f-2-A), the [Secretary](/usc/16/410r–5.md?p=c-1) shall submit to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate the general [management plan](/usc/16/544.md?p=k).
  - (3) **Related sites—** The [Secretary](/usc/16/410r–5.md?p=c-1) may provide interpretative tours and educational programs at related historic and cultural sites within the Historic District associated with the purposes for which the Historical [Park](/usc/16/410r–5.md?p=c-3) is established.
- (g) **Cooperative agreements—**
  - (1) **In general—** The [Secretary](/usc/16/410r–5.md?p=c-1) may provide technical assistance and enter into cooperative agreements with the [owner](/usc/16/429b–3.md?p=4) of a nationally significant property within the Historical [Park](/usc/16/410r–5.md?p=c-3) or the Historic District, to identify, mark, interpret, improve, and restore the property.
  - (2) **Right of access—** A cooperative agreement entered into under [paragraph (1)](#g-1) shall provide that the [Secretary](/usc/16/410r–5.md?p=c-1), acting through the Director of the National [Park](/usc/16/410r–5.md?p=c-3) Service, shall have the right of access at all reasonable times to all public portions of the property covered by the agreement for the purposes of—
    - (A) conducting visitors through the property; and
    - (B) interpreting the property for the public.
  - (3) **Cost-sharing requirement—**
    - (A) **Federal share—** The Federal share of the total cost of any activity carried out under a cooperative agreement entered into under this subsection shall be not more than 50 percent.
    - (B) **Form of non-Federal share—** The non-Federal share of an activity carried out under a cooperative agreement entered into under this subsection may be in the form of donated property, goods, or services fairly valued.
  - (4) **Changes or alterations—** No changes or alterations shall be made to any property or [project](/usc/16/410r–5.md?p=c-4) covered by a cooperative agreement entered into under [paragraph (1)](#g-1) unless the [Secretary](/usc/16/410r–5.md?p=c-1) and the other party to the agreement agree to the changes or alterations.
  - (5) **Conversion, use, or disposal—** Any payment by the [Secretary](/usc/16/410r–5.md?p=c-1) under this subsection shall be subject to an agreement that the conversion, use, or disposal of a property or [project](/usc/16/410r–5.md?p=c-4) for purposes contrary to the purposes of this section, as determined by the [Secretary](/usc/16/410r–5.md?p=c-1), shall entitle the United States to reimbursement in any amount equal to the greater of—
    - (A) the amounts made available to the property or [project](/usc/16/410r–5.md?p=c-4) by the United States; or
    - (B) the portion of the increased value of the property or [project](/usc/16/410r–5.md?p=c-4) attributable to the amounts made available under this subsection, as determined at the time of the conversion, use, or disposal.
- (h) **Limited role of the Secretary—** Nothing in this section authorizes the [Secretary](/usc/16/410r–5.md?p=c-1) to assume overall financial responsibility for the operation, maintenance, or management of the Historic District.
