# §410o. Exchange of land, water, and interests therein


The [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior is authorized to transfer to the [State](/usc/16/590q.md?p=a) of Florida by quitclaim deed the land, water, and interests therein, previously acquired by the United States of America for Everglades National [Park](/usc/16/410r–5.md?p=c-3) and not included within such [park](/usc/16/410r–5.md?p=c-3) by [section 410i of this title](/usc/16/410i.md), such transfer to be in exchange for the conveyance by the [State](/usc/16/590q.md?p=a) of Florida to the United States of all land, water, and interests therein, owned by the [State](/usc/16/590q.md?p=a) within the boundary of the [park](/usc/16/410r–5.md?p=c-3) as described in [section 410i of this title](/usc/16/410i.md): Provided, That exclusion of any land, water, and interests therein from the [park](/usc/16/410r–5.md?p=c-3) boundary pursuant to [section 410i of this title](/usc/16/410i.md) shall be dependent upon the contemporaneous conveyance by the [State](/usc/16/590q.md?p=a) to the United States of all land, water, and interests therein, owned by the [State](/usc/16/590q.md?p=a) within the [park](/usc/16/410r–5.md?p=c-3) boundary described in [section 410i of this title](/usc/16/410i.md), including land, water, and interests therein, heretofore conveyed to the [State](/usc/16/590q.md?p=a), for transfer to the United States for inclusion in Everglades National [Park](/usc/16/410r–5.md?p=c-3). The effectuation of the transfer provided for in this section shall be a condition precedent to the [acquisition](/usc/16/620e.md?p=1) by the [Secretary](/usc/16/410r–5.md?p=c-1) of any land, water, or interests therein held in private ownership within the boundaries set forth in [section 410i of this title](/usc/16/410i.md) and outside the [area](/usc/16/539m–1.md?p=1-A) designated in sections [410e](/usc/16/410e.md) to [410h](/usc/16/410h.md) of this title, except as such [acquisition](/usc/16/620e.md?p=1) is by donation.
