# §410kkk–4. Private property protection

- (a) **Access to private property—** Nothing in this subchapter shall be construed to—
  - (1) require any private property [owner](/usc/16/429b–3.md?p=4) to permit public access (including Federal, [State](/usc/16/590q.md?p=a), or local government access) to such private property; or
  - (2) modify any provision of Federal, [State](/usc/16/590q.md?p=a), or local law with regard to public access to or use of [private lands](/usc/16/620e.md?p=6).
- (b) **Liability—** Designation of the [park](/usc/16/410kkk.md?p=1) shall not be considered to create any liability, or to have any effect on any liability under any other law, of any private property [owner](/usc/16/429b–3.md?p=4) with respect to any [persons](/usc/16/450rr–1.md?p=b) injured on such private property.
- (c) **Recognition of authority to control land use—** Nothing in this subchapter shall be construed to modify any authority of Federal, [State](/usc/16/590q.md?p=a), or local governments to regulate the use of private land within the boundary of the [park](/usc/16/410kkk.md?p=1).
