# §410hhh–6. Acquisition of property and boundary adjustments

- (a) **Acquisition authority—**
  - (1) Within the [area](/usc/16/539m–1.md?p=1-A) depicted on the [map](/usc/16/410hhh–1.md?p=3) as the “[Acquisition](/usc/16/620e.md?p=1) [Area](/usc/16/539m–1.md?p=1-A)” or the [national monument](/usc/16/410hhh–1.md?p=4), the [Secretary](/usc/16/410hhh–1.md?p=9) may [acquire](/usc/16/620e.md?p=1) lands and interests therein by purchase, donation, transfer from another Federal agency, or exchange: Provided, That lands or interests therein may only be acquired with the consent of the [owner](/usc/16/429b–3.md?p=4) thereof.
  - (2) Lands or interests therein owned by the [State](/usc/16/590q.md?p=a) of Colorado, or a political [subdivision](/usc/16/539m–1.md?p=15) thereof, may only be acquired by donation or exchange.
- (b) **Boundary adjustment—** As soon as practicable after the [acquisition](/usc/16/620e.md?p=1) of any land or interest under this section, the [Secretary](/usc/16/410hhh–1.md?p=9) shall modify the boundary of the [unit](/usc/16/430f–7.md?p=4) to which the land is transferred pursuant to [subsection (b)](#b)[^1] to include any land or interest acquired.
- (c) **Administration of acquired lands—**
  - (1) **General authority—** Upon [acquisition](/usc/16/620e.md?p=1) of lands under [subsection (a)](#a), the [Secretary](/usc/16/410hhh–1.md?p=9) shall, as appropriate—
    - (A) transfer administrative jurisdiction of the lands to the [National Park](/usc/16/410hhh–1.md?p=5) Service—
      - (i) for [addition](/usc/16/410r–5.md?p=c-2) to and management as part of the Great Sand Dunes [National Monument](/usc/16/410hhh–1.md?p=4), or
      - (ii) for [addition](/usc/16/410r–5.md?p=c-2) to and management as part of the Great Sand Dunes [National Park](/usc/16/410hhh–1.md?p=5) (after designation of the [Park](/usc/16/410r–5.md?p=c-3)) or the Great Sand Dunes National [Preserve](/usc/16/410hhh–1.md?p=7); or
    - (B) transfer administrative jurisdiction of the lands to the United States [Fish and Wildlife](/usc/16/3102.md?p=17) Service for [addition](/usc/16/410r–5.md?p=c-2) to and administration as part of the Baca National [Wildlife Refuge](/usc/16/410hhh–1.md?p=6).
  - (2) **Forest service administration—**
    - (A) Any lands acquired within the [area](/usc/16/539m–1.md?p=1-A) depicted on the [map](/usc/16/410hhh–1.md?p=3) as being located within Zone B shall be transferred to the [Secretary](/usc/16/410hhh–1.md?p=9) of Agriculture and shall be added to and managed as part of the Rio Grande National Forest.
    - (B) For the purposes of sections [100506(c)](/usc/54/100506.md?p=c) and [200306](/usc/54/200306.md) of title 54, the boundaries of the Rio Grande National Forest, as revised by the transfer of land under paragraph (A), shall be considered to be the boundaries of the national forest.
