# §3323. Approval and funding of projects

- (a) **In general—** The [Secretary](/usc/16/410r–5.md?p=c-1), in consultation with the [Secretary](/usc/16/410r–5.md?p=c-1) of Commerce, may approve any [project](/usc/16/410r–5.md?p=c-4) that is consistent with an approved [enhancement](/usc/16/3302.md?p=8) plan and the provisions of this chapter, and shall promptly notify the [States](/usc/16/544.md?p=r), the [treaty tribes](/usc/16/3302.md?p=16) and, upon request, any other interested party of the approval of a [project](/usc/16/410r–5.md?p=c-4) and the amount of funding made available under this chapter for such [project](/usc/16/410r–5.md?p=c-4).
- (b) **Limitations on Federal share—** The total Federal share of all [enhancement](/usc/16/3302.md?p=8) [projects](/usc/16/410r–5.md?p=c-4) funded annually by this section shall not exceed 50 percent of the total amount expended for such [projects](/usc/16/410r–5.md?p=c-4), except that this limitation shall not apply to [projects](/usc/16/410r–5.md?p=c-4) proposed by [treaty tribes](/usc/16/3302.md?p=16) acting through the [appropriate tribal coordinating body](/usc/16/3302.md?p=1). A [State](/usc/16/590q.md?p=a) share may include both real and personal property. Title to, or other interest in, such property shall remain within the [State](/usc/16/590q.md?p=a). The [State](/usc/16/590q.md?p=a) of Washington shall be treated on December 22, 1980, as having expended $32,000,000 (reduced by the amount treated as expended by the [State](/usc/16/590q.md?p=a) under [section 3336 of this title](/usc/16/3336.md)) on [enhancement](/usc/16/3302.md?p=8) proj­ects set forth in the plan which are eligible for assistance under this chapter. The Federal share shall be paid in such amounts and at such times as the [Secretary](/usc/16/410r–5.md?p=c-1) deems appropriate, consistent with this chapter and the goals of the comprehensive plan.
