# §3312. Eligibility for financial assistance under approved enhancement plans


Upon approval by the [Secretary](/usc/16/410r–5.md?p=c-1) of the [Commission](/usc/16/544.md?p=c)’s report under [section 3311 of this title](/usc/16/3311.md), a [State](/usc/16/590q.md?p=a) represented by a voting member on the [Commission](/usc/16/544.md?p=c) and any [treaty tribe](/usc/16/3302.md?p=16) represented by a tribal coordinating body shall be eligible for financial assistance under subchapter III if the [State](/usc/16/590q.md?p=a) or [treaty tribe](/usc/16/3302.md?p=16) enters into an agreement with the [Secretary](/usc/16/410r–5.md?p=c-1) under which that [State](/usc/16/590q.md?p=a) or [treaty tribe](/usc/16/3302.md?p=16) obligates itself—

- (1) to implement and enforce the provisions of the report and revisions thereto, through laws, regulations, ordinances, or other appropriate means, within such geographical [areas](/usc/16/539m–1.md?p=1-A) and with respect to such [persons](/usc/16/450rr–1.md?p=b) as may be subject to its jurisdiction and to the extent of its enforcement power; and
- (2) to engage in such coordination and consultation as may be necessary or appropriate to ensure, to the maximum extent practicable, that the report and revisions thereto are fully and effectively implemented.
