# §3210. Access by owner to nonfederally owned land

- (a) **Reasonable use and enjoyment of land within boundaries of National Forest System—** Notwithstanding any other provision of law, and subject to such terms and conditions as the [Secretary](/usc/16/410r–5.md?p=c-1) of Agriculture may prescribe, the [Secretary](/usc/16/410r–5.md?p=c-1) shall provide such access to nonfederally owned land within the boundaries of the National Forest System as the [Secretary](/usc/16/410r–5.md?p=c-1) deems adequate to secure to the [owner](/usc/16/429b–3.md?p=4) the reasonable use and enjoyment thereof: Provided, That such [owner](/usc/16/429b–3.md?p=4) comply with rules and regulations applicable to ingress and egress to or from the National Forest System.
- (b) **Reasonable use and enjoyment of land surrounded by public lands managed by Secretary—** Notwithstanding any other provision of law, and subject to such terms and conditions as the [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior may prescribe, the [Secretary](/usc/16/410r–5.md?p=c-1) shall provide such access to nonfederally owned land surrounded by [public lands](/usc/16/620e.md?p=7) managed by the [Secretary](/usc/16/410r–5.md?p=c-1) under the [Federal Land](/usc/16/3102.md?p=2) Policy and Management Act of 1976 ([43 U.S.C. 1701–82](https://uscode.house.gov/view.xhtml?req=(/us/usc/t43/s1701–82))) as the [Secretary](/usc/16/410r–5.md?p=c-1) deems adequate to secure to the [owner](/usc/16/429b–3.md?p=4) the reasonable use and enjoyment thereof: Provided, That such [owner](/usc/16/429b–3.md?p=4) comply with rules and regulations applicable to access across [public lands](/usc/16/620e.md?p=7).
