# §3202. Taking of fish and wildlife

- (a) **Responsibility and authority of State of Alaska—** Nothing in this Act is intended to enlarge or diminish the responsibility and authority of the [State](/usc/16/590q.md?p=a) of Alaska for management of [fish and wildlife](/usc/16/3102.md?p=17) on the [public lands](/usc/16/620e.md?p=7) except as may be provided in subchapter II of this chapter, or to amend the Alaska constitution.
- (b) **Responsibility and authority of Secretary—** Except as specifically provided otherwise by this Act, nothing in this Act is intended to enlarge or diminish the responsibility and authority of the [Secretary](/usc/16/410r–5.md?p=c-1) over the management of the [public lands](/usc/16/620e.md?p=7).
- (c) **Areas controlled; areas closed, exceptions—** The [taking](/usc/16/3102.md?p=18) of [fish and wildlife](/usc/16/3102.md?p=17) in all [conservation system units](/usc/16/3102.md?p=4), and in national conservation [areas](/usc/16/539m–1.md?p=1-A), national recreation [areas](/usc/16/539m–1.md?p=1-A), and national forests, shall be carried out in accordance with the provisions of this Act and other applicable [State](/usc/16/590q.md?p=a) and Federal law. Those [areas](/usc/16/539m–1.md?p=1-A) designated as national [parks](/usc/16/410r–5.md?p=c-3) or national [park](/usc/16/410r–5.md?p=c-3) system monuments in the [State](/usc/16/590q.md?p=a) shall be closed to the [taking](/usc/16/3102.md?p=18) of [fish and wildlife](/usc/16/3102.md?p=17), except that—
  - (1) notwithstanding any other provision of this Act, the [Secretary](/usc/16/410r–5.md?p=c-1) shall administer those [units](/usc/16/430f–7.md?p=4) of the National [Park](/usc/16/410r–5.md?p=c-3) System, and those [additions](/usc/16/410r–5.md?p=c-2) to existing [units](/usc/16/430f–7.md?p=4), established by this Act and which permit subsistence uses, to provide an opportunity for the continuance of such uses by local rural residents; and
  - (2) fishing shall be permitted by the [Secretary](/usc/16/410r–5.md?p=c-1) in accordance with the provisions of this Act and other applicable [State](/usc/16/590q.md?p=a) and Federal law.
