# §192b–9. Rocky Mountain National Park, Roosevelt National Forest, and the Arapaho National Forest

- (a) **Revision of boundaries—** The boundaries of Rocky Mountain National [Park](/usc/16/410r–5.md?p=c-3), the Roosevelt National Forest, and the Arapaho National Forest are revised as generally depicted on the [map](/usc/16/430f–7.md?p=1) entitled “Boundary Adjustments, Rocky Mountain National [Park](/usc/16/410r–5.md?p=c-3)”, numbered 121–80,047, dated October 1, 1979, which shall be on file and available for public inspection in the Office of the Director, National [Park](/usc/16/410r–5.md?p=c-3) Service, Department of the Interior, and the Office of the Chief, Forest Service, Department of Agriculture: Provided, That the [area](/usc/16/539m–1.md?p=1-A) shown on such [map](/usc/16/430f–7.md?p=1) as E–5 and known as the Twin Sisters [area](/usc/16/539m–1.md?p=1-A) shall remain a part of the Rocky Mountain National [Park](/usc/16/410r–5.md?p=c-3). All lands added or transferred by this Act to Rocky Mountain National [Park](/usc/16/410r–5.md?p=c-3), Roosevelt National Forest, and Arapaho National Forest shall be subject to the laws and regulations applicable to the appropriate National [Park](/usc/16/410r–5.md?p=c-3) or National Forest. Lands within the Indian Peaks [Wilderness](/usc/16/3102.md?p=13) [Area](/usc/16/539m–1.md?p=1-A) as designated by Public Law 95–450 (92 Stat. 1099) [[16 U.S.C. 460jj](/usc/16/460jj.md) et seq.], that are transferred by this Act to Rocky Mountain National [Park](/usc/16/410r–5.md?p=c-3) shall remain in the [National Wilderness Preservation System](/usc/16/3102.md?p=13). Lands within the Rocky Mountain National [Park](/usc/16/410r–5.md?p=c-3) that are adjacent to the Indian Peaks [Wilderness](/usc/16/3102.md?p=13) and that are transferred by this Act to the Roosevelt National Forest shall be incorporated in and become part of the Indian Peaks [Wilderness](/usc/16/3102.md?p=13).
- (b) **Acquisition of lands and interest; functions of Secretary of the Interior and Secretary of Agriculture—** The [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior, with respect to lands added or transferred by this Act to Rocky Mountain National [Park](/usc/16/410r–5.md?p=c-3), and the [Secretary](/usc/16/410r–5.md?p=c-1) of Agriculture, with respect to lands added or transferred by this Act to Roosevelt and Arap­aho National Forests, may [acquire](/usc/16/620e.md?p=1) lands and interests in such lands, by donation, purchase with donated or appropriated funds, or by exchange. The [Secretary](/usc/16/410r–5.md?p=c-1) of Agriculture, under sections [485](/usc/16/485.md) and [486](/usc/16/486.md) of this title, may accept on behalf of the United States title to any land in [section 30](/usc/16/30.md), township 7 north, range 73 west, of the sixth principal meridian which lies within the boundary of Rocky Mountain National [Park](/usc/16/410r–5.md?p=c-3) as revised by this Act, in exchange for which the [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior, notwithstanding [section 1279(a) of this title](/usc/16/1279.md?p=a), is authorized to issue patent to lands lying within the Cache La Poudre Wild and Scenic River study corridor. Upon completion of the exchange, the [Secretary](/usc/16/410r–5.md?p=c-1) of Agriculture shall transfer to the administrative jurisdiction by the [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior the portion of such land lying within the boundary of the Rocky Mountain National [Park](/usc/16/410r–5.md?p=c-3) as revised by this Act.
- (c) **Transfer of certain areas by the Bureau of Land Management—** The [Federal lands](/usc/16/620e.md?p=2) within the administrative jurisdiction of the Bureau of Land Management and within the [areas](/usc/16/539m–1.md?p=1-A) referred to as E–2 and GL–3 on the [map](/usc/16/430f–7.md?p=1) referred to in [subsection (a)](#a) shall be transferred to Rocky Mountain National [Park](/usc/16/410r–5.md?p=c-3) without transfer of funds.
- (d) **City of Longmont, Colorado; retention of certain areas for the development of a reservoir—** If the city of Longmont, Colorado, notifies the [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior that lands within the [area](/usc/16/539m–1.md?p=1-A) referred to as E–8 on the [map](/usc/16/430f–7.md?p=1) referred to in [subsection (a)](#a) of this section that are owned by such city are necessary for the development of a reservoir, the [Secretary](/usc/16/410r–5.md?p=c-1) shall by publication of a revised boundary description in the Federal Register revise the boundary of Rocky Mountain [Park](/usc/16/410r–5.md?p=c-3) within such [area](/usc/16/539m–1.md?p=1-A) to exclude the lands which are necessary for the development of the reservoir: Provided, That the authority of such [Secretary](/usc/16/410r–5.md?p=c-1) to revise the boundary for this purpose shall expire on November 1, 1981; and the only lands which may be excluded are the approximately one hundred twenty-nine acres owned by such city.
- (e) **Old McGregor Ranch; retention by owners—** If after the completion of two complete fiscal years following December 22, 1980, the [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior has not purchased interests in the lands of approximately one thousand two hundred acres known as the Old McGregor Ranch located within the [area](/usc/16/539m–1.md?p=1-A) referred to as E–2 on the [map](/usc/16/430f–7.md?p=1) referred to in [subsection (a)](#a), and the [owner](/usc/16/429b–3.md?p=4) of such lands petitions the [Secretary](/usc/16/410r–5.md?p=c-1) to exclude such lands from Rocky Mountain National [Park](/usc/16/410r–5.md?p=c-3), the [Secretary](/usc/16/410r–5.md?p=c-1) shall by publication of a revised boundary description in the Federal Register return the boundary of Rocky Mountain National [Park](/usc/16/410r–5.md?p=c-3) in such [area](/usc/16/539m–1.md?p=1-A) E–2 to the boundary as it existed before December 22, 1980.
- (f) **City of Grand Lake, Colorado; conveyance of land by the Secretary—** The [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior shall convey, to the city of Grand Lake, Colorado, without compensation or consideration, the lands, not to exceed two acres, within the [area](/usc/16/539m–1.md?p=1-A) referred to as GL–5 on the [map](/usc/16/430f–7.md?p=1) referred to in [subsection (a)](#a).
- (g) **Use of snowmobiles in certain areas—** The [Secretary](/usc/16/410r–5.md?p=c-1) of the Interior may provide for the use of snowmobiles along the East Shore Trail of Shadow Mountain Lake if after study the [Secretary](/usc/16/410r–5.md?p=c-1) determines such use will not result in any significant adverse impact upon wildlife.

### Encouragement of Land Exchanges

Pub. L. 104–333, div. I, title IV, § 408(b), Nov. 12, 1996, 110 Stat. 4153, provided that: Lands inside rocky mountain national park.—Promptly following enactment of this Act [Nov. 12, 1996], the Secretary of the Interior shall seek to acquire by donation or exchange those lands within the boundaries of Rocky Mountain National Park owned by the city of Longmont, Colorado, that are referred to in section 111(d) of the Act commonly referred to as the ‘Colorado Wilderness Act of 1980’ (Public Law 96–560; 94 Stat. 3272; 16 U.S.C. 192b–9(d)). Other lands.—The Secretary of Agriculture shall immediately and actively pursue negotiations with the city of Longmont, Colorado, concerning the city’s proposed exchange of lands owned by the city and located in and near Coulson Gulch for other lands owned by the United States. The Secretary shall report to Congress 2 calendar years after the date of enactment of this Act [Nov. 12, 1996], and every 2 years thereafter on the progress of such negotiations until negotiations are complete.”
