# §1a–7b. Protection of right of individuals to bear arms

- (a) **Congressional findings—** Congress finds the following:
  - (1) The 2d amendment to the Constitution provides that “the right of the people to keep and bear Arms, shall not be infringed”.
  - (2) [Section 27.42 of title 50, Code of Federal Regulations](/cfr/50/27.42.md), provides that, except in special circumstances, citizens of the United States may not “possess, use, or transport firearms on national [wildlife refuges](/usc/16/410hhh–1.md?p=6)” of the United States Fish and Wildlife Service.
  - (3) The regulations described in [paragraph (2)](#a-2) prevent individuals complying with Federal and [State](/usc/16/6456.md?p=2) laws from exercising the 2d amendment rights of the individuals while at [units](/usc/16/430f–7.md?p=4) of the National [Wildlife Refuge](/usc/16/410hhh–1.md?p=6) [System](/usc/16/668ee.md?p=14).
  - (4) The existence of different laws relating to the transportation and possession of firearms at different [units](/usc/16/430f–7.md?p=4) of the National [Wildlife Refuge](/usc/16/410hhh–1.md?p=6) [System](/usc/16/668ee.md?p=14) entrapped law-abiding gun [owners](/usc/16/429b–3.md?p=4) while at [units](/usc/16/430f–7.md?p=4) of the National [Wildlife Refuge](/usc/16/410hhh–1.md?p=6) [System](/usc/16/668ee.md?p=14).
  - (5) Although the Bush administration issued new regulations relating to the 2d amendment rights of law-abiding citizens in [units](/usc/16/430f–7.md?p=4) of the National [Wildlife Refuge](/usc/16/410hhh–1.md?p=6) [System](/usc/16/668ee.md?p=14) that went into effect on January 9, 2009—
    - (A) on March 19, 2009, the United States District Court for the District of Columbia granted a preliminary injunction with respect to the implementation and enforcement of the new regulations; and
    - (B) the new regulations—
      - (i) are under review by the Obama administration; and
      - (ii) may be altered.
  - (6) Congress needs to weigh in on the new regulations to ensure that unelected bureaucrats and judges cannot again override the 2d amendment rights of law-abiding citizens on 90,790,000 acres of land under the jurisdiction of the United States Fish and Wildlife Service.
  - (7) Federal laws should make it clear that the 2d amendment rights of an individual at a [unit](/usc/16/430f–7.md?p=4) of the National [Wildlife Refuge](/usc/16/410hhh–1.md?p=6) [System](/usc/16/668ee.md?p=14) should not be infringed.
- (b) **Protection of right of individuals to bear arms in units of the National Wildlife Refuge System—** The [Secretary](/usc/16/410r–5.md?p=c-1) shall not promulgate or enforce any regulation that prohibits an individual from possessing a firearm, including an assembled or functional firearm, in any [unit](/usc/16/430f–7.md?p=4) of the National [Wildlife Refuge](/usc/16/410hhh–1.md?p=6) [System](/usc/16/668ee.md?p=14) if—
  - (1) the individual is not otherwise prohibited by law from possessing the firearm; and
  - (2) the possession of the firearm is in compliance with the law of the [State](/usc/16/6456.md?p=2) in which the [unit](/usc/16/430f–7.md?p=4) of the National [Wildlife Refuge](/usc/16/410hhh–1.md?p=6) [System](/usc/16/668ee.md?p=14) is located.

# §17j–2. Authorization of appropriations for road maintenance and repair, etc.


Appropriations for the [National Park](/usc/16/410hhh–1.md?p=5) Service are authorized for—

- (a) Necessary protection of the [area](/usc/16/539m–1.md?p=1-A) of federally owned land in the custody of the [National Park](/usc/16/410hhh–1.md?p=5) Service known as the Ocean Strip and Queets Corridor, adjacent to Olympic [National Park](/usc/16/410hhh–1.md?p=5), Washington; necessary repairs to the roads from Glacier [Park](/usc/16/410r–5.md?p=c-3) Station through the Blackfeet Indian Reservation to the various points in the boundary line of Glacier [National Park](/usc/16/410hhh–1.md?p=5), Montana, and the international boundary; repair and maintenance of approximately two and seventy-seven one-hundredths miles of road leading from United States Highway 187 to the north entrance of Grand Teton [National Park](/usc/16/410hhh–1.md?p=5), Wyoming; maintenance of approach roads through the Lassen [National Forest](/usc/16/5207.md?p=3) leading to Lassen Volcanic [National Park](/usc/16/410hhh–1.md?p=5), California; maintenance and repair of the Generals Highway between the boundaries of Sequoia [National Park](/usc/16/410hhh–1.md?p=5), California, and the Grant Grove section of Kings Canyon [National Park](/usc/16/410hhh–1.md?p=5), California; maintenance of approximately two and one-fourth miles of roads comprising those portions of the Fresno-Kings Canyon approach road, [Park](/usc/16/410r–5.md?p=c-3) Ridge Lookout Road, and Ash Mountain-Advance truck trail, necessary to the administration and protection of the Sequoia and Kings Canyon [National Parks](/usc/16/410hhh–1.md?p=5); maintenance of the roads in the [national forests](/usc/16/5207.md?p=3) leading out of Yellowstone [National Park](/usc/16/410hhh–1.md?p=5), Wyoming, Idaho, and Montana; maintenance of the road in the Stanislaus [National Forest](/usc/16/5207.md?p=3) connecting the Tioga Road with the Hetch Hetchy Road near Mather Station, Yosemite [National Park](/usc/16/410hhh–1.md?p=5), California; and maintenance and repair of the approach road to the Little Bighorn Battlefield National Monument and the road connecting the said monument with the Reno Monument site, Montana; repair and maintenance of the class “C” road lying between the terminus of F.A. 383 at the east boundary of Coronado [National Forest](/usc/16/5207.md?p=3) and the point where said class “C” road enters Coronado National [Memorial](/usc/16/450ss–1.md?p=2) in the vicinity of Montezuma Pass, approximately 5.3 miles.
