# §8710. Suspension or termination

- (a) **Mandatory suspension or termination—** The [Secretary](/usc/15/8702.md?p=18) shall suspend or terminate an [order](/usc/15/8702.md?p=14) or a provision of an [order](/usc/15/8702.md?p=14) if the [Secretary](/usc/15/8702.md?p=18) finds that an [order](/usc/15/8702.md?p=14) or provision of an [order](/usc/15/8702.md?p=14) obstructs or does not tend to effectuate the purpose of this chapter, or if the [Secretary](/usc/15/8702.md?p=18) determines that the [order](/usc/15/8702.md?p=14) or a provision of an [order](/usc/15/8702.md?p=14) is not favored by a majority of all votes cast in the referendum as provided in [section 8706(a)(2) of this title](/usc/15/8706.md?p=a-2).
- (b) **Implementation of suspension or termination—** If, as a result of a referendum conducted under [section 8706 of this title](/usc/15/8706.md), the [Secretary](/usc/15/8702.md?p=18) determines that the [order](/usc/15/8702.md?p=14) is not approved, the [Secretary](/usc/15/8702.md?p=18) shall—
  - (1) not later than 180 days after making the determination, suspend or terminate, as the case may be, collection of assessments under the [order](/usc/15/8702.md?p=14); and
  - (2) as soon as practicable, suspend or terminate, as the case may be, activities under the [order](/usc/15/8702.md?p=14) in an orderly manner.
