# §8703. Issuance of orders

- (a) **In general—**
  - (1) **Issuance—** The [Secretary](/usc/15/8702.md?p=18), subject to the procedures provided in [subsection (b)](#b), shall issue [orders](/usc/15/8702.md?p=14) under this chapter applicable to [manufacturers](/usc/15/8702.md?p=12) of [concrete masonry products](/usc/15/8702.md?p=4).
  - (2) **Scope—** Any [order](/usc/15/8702.md?p=14) shall be national in scope.
  - (3) **One order—** Not more than 1 [order](/usc/15/8702.md?p=14) shall be in effect at any one time.
- (b) **Procedures—**
  - (1) **Development or receipt of proposed order—** A proposed [order](/usc/15/8702.md?p=14) with respect to the generic [research](/usc/15/8702.md?p=17), [education](/usc/15/8702.md?p=9), and [promotion](/usc/15/8702.md?p=16) with regards to [concrete masonry products](/usc/15/8702.md?p=4) may be—
    - (A) proposed by the [Secretary](/usc/15/8702.md?p=18) at any time; or
    - (B) requested by or submitted to the [Secretary](/usc/15/8702.md?p=18) by—
      - (i) an existing national organization of concrete masonry product [manufacturers](/usc/15/8702.md?p=12); or
      - (ii) any [person](/usc/15/8702.md?p=15) that may be affected by the issuance of an [order](/usc/15/8702.md?p=14).
  - (2) **Publication of proposed order—** If the [Secretary](/usc/15/8702.md?p=18) determines that a proposed [order](/usc/15/8702.md?p=14) received in accordance with [paragraph (1)(B)](#b-1-B) is consistent with and will effectuate the purpose of this chapter, the [Secretary](/usc/15/8702.md?p=18) shall publish such proposed [order](/usc/15/8702.md?p=14) in the Federal Register not later than 90 days after receiving the [order](/usc/15/8702.md?p=14), and give not less than 30 days notice and opportunity for public comment on the proposed [order](/usc/15/8702.md?p=14).
  - (3) **Issuance of order—**
    - (A) **In general—** After notice and opportunity for public comment are provided in accordance with [paragraph (2)](#b-2), the [Secretary](/usc/15/8702.md?p=18) shall issue the [order](/usc/15/8702.md?p=14), taking into consideration the comments received and including in the [order](/usc/15/8702.md?p=14) such provisions as are necessary to ensure that the [order](/usc/15/8702.md?p=14) is in conformity with this chapter.
    - (B) **Effective date—** If there is an affirmative vote in a referendum as provided in [section 8706 of this title](/usc/15/8706.md), the [Secretary](/usc/15/8702.md?p=18) shall issue the [order](/usc/15/8702.md?p=14) and such [order](/usc/15/8702.md?p=14) shall be effective not later than 140 days after publication of the proposed [order](/usc/15/8702.md?p=14).
- (c) **Amendments—** The [Secretary](/usc/15/8702.md?p=18) may, from time to time, amend an [order](/usc/15/8702.md?p=14). The provisions of this chapter applicable to an [order](/usc/15/8702.md?p=14) shall be applicable to any amendment to an [order](/usc/15/8702.md?p=14).
